Hi Folks, I am extremly happy to inform you that I got my Green Card process completed in a record time of one year. I am just back from India after finishing the CP Interview in Chennai successfully. Mr. Rajiv , Ms. Fidelina Baptista and all his staff Suman Bhasin, Amel Berhe, Leila Lehman, Nimia were very helpful in the entire process. Needless to mention that Mr. Rajive is very good in handling EB2 cases. They did a great job in getting my labour and I-140 approvals and also cooperated very well in my persuit through CP instead of the regular I-485. During my I-140 stage, when I called and asked Mr. Rajiv that I want to opt for CP, he immediately agreed and accepted the challenge though it was not very popular at that time. I am extremly thankful to the entire Law office of Mr. Khanna without which I would not have got my Green Card so fast. I just got the I-485 approval yesterday in the mail and Rajiv informed me about it through an email. Rajiv used the RIR process for my labor certification, getting the LCA in a very quick 3 months time period. I had to wait for my PD to become current to file the I-485. My dates. I'm working in an organization since December 2009. When my green card was filed in January 2016 my job title was "Senior Engineer", and the roles and responsibilities included following -

My I-140 is approved, and Priority Date is January 2016. I'm due for promotion to the job title "Consultant", and the roles and responsibilities would be following -

· Able to talk accurately about the whole product whenever and wherever regardless of audience
· “Manager” on the floor, a mentor to “all” that need help, trusted adviser
· The one that the Engineer level people go to and want to be

My Manager and HR mentioned that they will have to file amendment for change in roles and responsibilities that matches with new title. They are concerned about filing amendment, and they mentioned that they are seeing less than 50/50 success rate and there is high risk involved in changing title as my green card might get declined.

I'm very surprised that changing only couple of responsibilities can jeopardize my green card processing, and I'm also finding it unbelievable that I can't get any promotion within same organization till my GC is approved, which could be another 10-15 years.

I thought since green card is filed for the future position, so there should not be much risk involved in filing amendment. I've seen many of my friends and family getting promotions within same organization after their green card process started. Since I'll be working in same organization and same team, and there is no drastic change in roles and responsibilities, so do we still have to file amendment? Can the amendment be filed later with I-485, or is it better to go back to old job without filing amendment?

Ours is a long story. My green card was filed under EB3 India with a PD of May 2006. My husband's green card was filed under EB3 India in 2005. When our dates became current sometime in 2007, my I-140 was already approved and his was pending. So, we decided to go ahead with my case and filed for I-485 for both of us. However, the dates then retrogressed and our lawyer informed us that my husband's case is no longer valid since his LC expired 3 months after it was approved. We didn't know that LC expires if not used within a specific time frame and the lawyer did not inform us either. Anyways, my husband's GC was again filed, this time through Rajiv's firm with proper guidance and through EB2. Rajiv also guided us to go through Consular Processing instead of I-485 since in our case, my husband could legally work using EAD via the I-485 applied through my case. In all these years, the company I work for has increased in size and wants to promote me. I consulted with Rajiv regarding this and inquired about possibility for porting from EB3 to EB2. Rajiv answered all our questions and guided us appropriately this time too. We are now waiting to hear about the Priority Dates for October 2012 bulletin and will make a decision about EB3 to EB2 porting. It feels so good to be able to talk to Rajiv regarding these questions related to immigration and his knowledge and experience in this field is very very valuable for people like us.
