Legal Fees (for our Office):   $1,600 payable at the commencement of the case (not including responses to Requests For Evidence)

Note: For Governmental Request For Evidence (RFE) that address issues beyond a routine H-1B filing we will charge extra based upon the complexity of the issue. 

2. Filing Fees (to the USCIS, Form I-129, separate checks):      
  Regular processing:   $460 (Increase to $780 with effect from April 1, 2024)
  Premium processing: additional $2,500 ($2,805 from Feb 26, 2024)
3.  Filing Fees (to the USCIS, Form I-129 H-1B Data Collection Supplement):
  For a company with 26 or more employees, a fee of $1,500 
  For a company with 25 or less employees, a fee of $750
4 Fraud Prevention Fee : $500
5.  Miscellaneous Expenses:
  Federal Express Expenses:   appx. $100
Note: If the beneficiary holds no US degrees, a credentials evaluation may be necessary.  The evaluators usually charge anywhere from $75 -$275 for education and experience.

Additional expenses: 

  1. For H-4 visas we charge an additional $300 legal fee for any number of applicants for clients who process their H-1 from our office.
  2. For H-1, if you are a company with 25 or less employees, the fees are as follows: $460 (filing fees for Form I-129) made payable to the "Department of Homeland Security" , $750 (filing fees for Form I-129 H-1B Data Collection Supplement) made payable to the "Department of Homeland Security" AND $500 Fraud Prevention and Detection fee made payable to the "Department of Homeland Security".
  3. For H-1, If you are a company with 26 or more employees, the fees are as follows: $460 (filing fees for Form I-129) made payable to the "Department of Homeland Security", $1,500 (filing fees for Form I-129 H-1B Data Collection Supplement) made payable to the "Department of Homeland Security" AND $500 Fraud prevention and detection fee made payable to the "Department of Homeland Security".
  4. The $500 Fraud prevention and detection fee will be applicable to:
    a) All initial H-1 petitions;
    b) Transfers from one employer to another; and
    c) Change of Status to H-1
    This $500 Fraud Prevention and Detection fee will be made payable to “Department of Homeland Security”.

NOTE: This additional fee of $1,500 and $750 is according to the Consolidated Appropriations Act of 2005 that was enacted on Dec 8, 2004. This Act reinstitutes the ACWIA fee and raises it to $1,500 for companies with 26 or more employees, including any affiliate or subsidiary. Companies with 25 or less employees may submit a reduced fee of $750.

Exceptions to Paying the ACWIA Fee for H-1B Petitions  The following organizations are not required to pay the ACWIA fee:

  • An institution of higher education as defined in section 101(a) of the Higher Education Act of 1965;
  • A nonprofit entity that is related to or affiliated with an institution of higher education, as defined in section 101(a) of the Higher Education Act of 1965;
  • A nonprofit research organization or governmental research organization;
  • A primary or secondary educational institution; or
  • A nonprofit entity which engages in an established curriculum-related clinical training program for students.

The ACWIA fee is also not required when:

  • A petitioner files its second or subsequent request for an extension of stay with the same employer for a foreign worker;
  • A petitioner files an amended petition that does not contain any requests to extend the validity of the petition it seeks to amend; or
  • A petition is filed solely to correct a USCIS error. However, to be considered exempt from the ACWIA fee, such petition may not contain any requests to extend the validity of the petition it seeks to correct, unless the USCIS error involves the validity dates.

Note1: If the H-1 is likely to be complicated, we do charge higher legal fees. Typically, $2,100 for cases with added difficulties.
Note 2: We charge the same for corporate or individual H-1 representation. 
Note 3: We charge the same fees for new cases and extensions.

  1. IF YOU ARE A COMPANY WITH 50 OR MORE EMPLOYEES AND MORE THAN 50% OF YOUR EMPLOYEES IS IN H-1 OR L-1/L-2 STATUS:
    A CHECK FOR $4,000.00 MADE PAYABLE TO THE “Department Of Homeland Security”.

Fee Increase for Certain H-1B and L-1 Petitions (Public Law 114-113)

Public Law 114-113 requires certain petitioners to pay an additional fee of $4,000 for certain H‑1B petitions and to pay an additional fee of $4,500 for certain L-1A and L-1B petitions. Signed into law on Dec. 18, 2015, the PL 114-113 fee applies to petitions filed on or after Dec. 18, 2015. The fee is in effect until Sept. 30, 2027.

NOTE: The additional fee previously required by Public Law 111-230, as amended, expired on September 30, 2015

If petition is by way of premium processing, then there is an additional fee of $2,500 ($2,805 from Feb 26, 2024), payable to "Department of Homeland Security".

 

The fee schedule for H-3 classification (fees are payable by corporate checks) is as follows: 

1. Legal fees (for our Office):  $2,200
2. USCIS filing fee:  $460  ($1,015; and $510 for small employers and nonprofits as of April 1, 2024)
3. Premium processing fee: $2,500 ($2,805 from Feb 26, 2024)

 

Fee schedule for H-4 classification (fees are payable by corporate checks)

1. Legal fees (for our Office):  For an independent H-4, $800 payable at the commencement of the case.
For an H-4 application being filed with an H-1 application, $300 payable at the commencement of the case.
2. Filing Fees (to the USCIS, Form I-539):   $370 (Increase to $470 with effect from April 1, 2024)
4. Federal Express Expenses:   approx. $70

 

Fee schedule for H-4 EAD classification (fees are payable by corporate checks)

1.

Legal fees (for our Office):  For an independent H-4 EAD, $800 payable at the commencement of the case.
For an H-4 EAD application being filed with an H-1 and H4 application, $600 payable at the commencement of the case.

NOTE: This legal fee does not include to responding to RFE's.  Additional fee would apply for RFE responses.

2. Filing Fees (to the USCIS, Form I-765):   $410 (Increase to $520 with effect from April 1, 2024)
3. Federal Express Expenses:   approx. $50

 

Compliance Audits and Investigation for H-1

$600 per file - minimum 10 files
If you scan and send us ten of your H-1 files, we can audit them and tell you how they should be corrected/improved. You can then implement the improved procedures for all cases.  Note that these are oral discussions only.  We will charge higher amounts for written reports.
