My H-1B visa is going to expire in 01-Jan-2018 and if my employer submits my PERM application in the month of June (i.e. before 6 months of my current 6 years of H-1B visa duration).
1) If my PERM gets approved before my current H-1B visa expires (i.e. before 01-Jan-2018).
Would I be eligible for a H1B extension for 1 year since my PERM was approved before the current H-1B expiration?
2) If my PERM gets approved after my current H-1B expires can my employer file for H1B extension of 1 year since my PERM is approved now.
3) If my PERM is not approved before my current H-1B visa expires.
Would I need to go back to India?
4) I spent about 2 months (on vacation) in India. Can these 2 months be added back to my current H-1B visa? or this can only be added if my current employer files for my green card?

I am a permanent resident, a citizen of Poland. I want to study medicine in Poland. The program lasts 6 years. I don't want to abandon my status and want to understand if such long-term abroad is possible. If I am not mistaken GC holder can be away 6month-1 year. But, since I'll be out of US on regular basis, so it's best to apply for a reentry permit?

I am in I-485 pending status based on EB2 and have been working on EAD since 2012. Under the new rules effective January 2017, I understand that I can file for EAD extension 180 days prior to expiration. Will EAD be considered extended automatically if the approval doesn't come before the expiration of my current EAD?

I am a US citizen and would like to sponsor my brother for Permanent Residency. How long would it take for him to get Green card.If I file green card for him, does his family (His wife and kids) automatically get green card or should I file for each of them? I think I should for all. Just a question? He gets a EAD (so he can start working) when I file Green Card?

We received our GC recently and would like to thank Mr. Khanna and his courteous and competent staff for their great work, which made this ardous process so smooth. Mr. Khanna especially is not only an excellent lawyer but also a good human being with a sympathetic ear. He always responds promptly even when the question is simple. I am very delighted to write our journey for O1 visa apporval for me and my wife with Mr. Rajiv ji and his excellent, highly professional and kind team. We approached to Mr. Khanna's law firm through my current employer, the process of writing the petition, collecting the papers and then review, edit and final submission was handled with the highest quality standards and as per the required regulations. We had several phone call discussions with Mr. Khanna, and to my surprise he knew every minute details of the information which was provided to him by us. Frankly speaking this was a truly professional at the same time a kind humanized approach from the team of Mr. Khanna. Special thanks goes to Ms. Diane Lombardo for her unconditional help, support and encouragement. We strongly recommend this firm to be used for any law related assignment. (e.g. visa, green card etc). Time management was excellent, follow up was extremely good. Best Regards, Dr. Manoj Jadhav,PhD, FCP

Effective December 18, 2015, H-2B workers identified as “returning workers” are exempted from the fiscal year (FY) 2016 annual H-2B cap of 66,000 visas. See Immigration and Nationality Act (INA) §214(g)(9)(a), 8 U.S.C. 1184(g)(9)(a), as revised by Consolidated Appropriations Act of 2016 (Public Law 114-113).
A returning worker is defined as an H-2B worker who was previously counted against the annual H-2B cap of 66,000 visas during FYs 2013, 2014, or 2015. This means:
USCIS published an updated editon of Form I-131, Application for Travel Document. The new edition is dated 01/22/16. (USCIS will continue to accept the 03/22/13 edition, but no other previous editions will be accepted.)
The Department of Homeland Security (DHS) amended its regulations today to improve the programs serving the H-1B1, E-3 and CW-1 nonimmigrant classifications and the EB-1 immigrant classification, and remove unnecessary hurdles that place such workers at a disadvantage when compared to similarly situated workers in other visa classifications.
USCIS published an updated editon of Form I-912P, HHS Poverty Guidelines for Fee Waiver Request. The new edition is dated 01/28/16. Previous editions should not be used.

Congress created the EB-5 visa program in 1990 as a tool to stimulate the U.S. economy by encouraging foreign capital investments and job creation. The EB-5 program makes immigrant visas and subsequent “green cards” available to foreign nationals who invest at least $1,000,000 in a new commercial enterprise (NCE) that will create or preserve at least ten full-time jobs in the United States. A foreign national may invest $500,000 if the investment is in a targeted employment area (TEA), defined to include certain rural areas and areas of high unemployment.
Thanks to Rajiv and Heather for successful approval of my I-140 approval. Journey started with some questions as student visa holder where Rajiv answered all of my questions with full patients and at the end of call he Refunded my fees bcoz he doesn't charge any fees to students. Next was H1b process where my chance of approval was very slim and the company was at its starting phase. Having no options on table we took a chance, with Rajiv's skills and tremendous experience he made the case that no one can deny it and we got it approved. Same thing with I140 stage where also chance of approval were very slim due to change in conditions of business, he offered me to abandon the case in middle and save his fees which I think no one in his profession would do that. Then we decided to put some faith in god and Rajiv' S expertise as we already knew he can make the case with any situations. and here we go I140 approved.............Hoorey.............he did it. Thank you you are the best ...
