I am going to India for my wedding, I plan to do my L1A stamping and get an L2 for my wife. Now suppose my L1A stamping is denied, what happenes to my existing L1b petition which is valid till 2011 Oct? Can I use that to file and L2 for my wife and return back to US?
Your current approval is not invalidated by denial of an L-1A. You can use it.
I have 3 yr Bachelor's degree (BSc) + 3 yr Bacheolor's degree in technology(BTech) from India and 8 years of experience. Do I qualify to apply for Green Card under EB2 category if the position requiers MS or BS+5 yr experience.
Usually, you are NOT permitted to put together two 3-year bach. degrees. So, it appears unlikely you will qualify for EB-2.
I have a GC since Nov 2004 and stayed in US for 3 years before moving to India on a temporary assignment. I have been in India for the past 2.5 years and have got a re-entry permit. When I return to US in April of next year, since it has been more than 5 years since I got GC and I had been physically present in US for over 2.5 years, will I be eligible for applying for citizenship?
Since you have been out of USA for more than one year, you will be eligible for naturalization only after 4 years and 1 day after you come back to live in USA.
Hi all, Finally I have got my GC approved. Just yesterday I recieved my card in mail. I am so happy and relieved because it has come in just the right time. Many thanks to everyone at immigration.com. These people are very professional. Specially I would like to thank Prerna, Vijay and Mathew for helping me out throgh out my GC process. I would highly recommend Immigration Law firm to anyone looking for representation in immigration matters. Best thing about them is you can actually talk to the lawyer or your assigned contact person yourself which unlike other law firms is almost impossible.. Great job guys..You are really the best.
SAN JUAN-Puerto Rico Governor Luis G. Fortuño extended last night the validity of birth certificates issued before July 1, 2010 to American citizens born in Puerto Rico for 30 additional days, until October 30, according to Secretary of State, Kenneth D. McClintock.

I was in my fifth year in USA without starting my LC process. Since it was a critical stage for me, I asked my company and Mr. Khanna to file PERM LC for me ASAP. My contact person, Seema, helped me a lot in preparing the case in a speedy manner and also answered all my questions promptly. Its a very good feeling when you work with nice and professional people. Today after three months of filing my case I received a "Congratulations" email from Seema that my LC got approved. Still have a long way to go but sure its a good start.
I am presently in Canada on Canadian PR (and have an indian passport). An employer in Indiana (from a hospitality background) is interested in hiring me.
1. They have no clue abt H1B visa. How do I proceed?
2. I was on J1 from 2000 to 2001. I do not have a waiver. Will this affect my application?
If you have neither complied with the J-1 home residency requirement, nor obtained a waiver, you cannot get an H-1. Make sure you are indeed subject to the 2-year HRR. You may not be - then an H-1 is a possibility. Go here to ask DOS for an advisory opinion: http://travel.state.gov/visa/temp/info/info_1288.html
My mother had an appoinment to get a visa today and she got denied but they did not give her a reason, is there a time period she should wait to try again or can we find out why somehow.
They are required by law to give a reason. Contact your Congressman.
I have been a petitioner for my brother since I offered it in 2002. Now, I don't want to be a sponser for my brother. Can I cancel it or not?
You can withdraw the Form I-130.

WASHINGTON—Under an executive order signed by the Governor of Puerto Rico, certified copies of Puerto Rico birth certificates issued before July 1, 2010, will now be valid through Oct. 30, 2010. The validity of those certificates had previously been set to expire on Sept. 30, 2010.
I would like to thank Rajiv, Mathew, and Suman for their work on my case.
My 485 was denied and I had only 15 days to respond back or else I would have lost my EAD too! I came to know about Rajiv from a friend and emailed him right away, the same evening I got the denial letter. Next morning, Rajiv called me personally and collected all the details from me. At that time, he wasn't even sure if he is going to take the case or not. My 485 was based on family and I had done all the paper work myself. I had my initial interview 2 years back (in 2006) where I was asked to provide my original birth certificate within next 90 days. That was the only thing needed for approving my 485. I had sent my hospital issued birth certificate shortly after that. Since then I never heard back from USCIS. After a few info-pass appointments, I got a denial letter in Feb 2008.
The USCIS procedure mandates to send a letter of "Intend to deny" if the evidence they ask for (birth certificate in my case) is not satisfactory. I never got the intention letter. Instead, I got the denial!
The case was complicated but Rajiv took the time to research how to proceed and finally he suggested we appeal via form 290B (Motion to Reopen/ Reconsider). Mathew and Suman promptly created all necessary paperwork. I managed to get the municipality issued Birth Certificate and we files the Motion to Reopen within 10 days of receiving the denial letter. USCIS took a little over a month and approved my motion.
Now I just have to wait for my 485 to get approved. I was very pleased to find Rajiv and his team. I wish them all the best in the endeavor to help thousands of people with USCIS.
Law offices of Rajiv S. Khanna has provided excellent service in getting my I-140 approved (EB1-OR) within a few months.
I have dealt with other law firms before and I have no hesitation in reserving the highest praise for the supporting staff and attorney Rajiv Khanna. Mr. Khanna has been very straightforward, understanding, committed,
and singularly knowledgeable.
Incredibly, he agreed to a consultation (where he reviewed my eligibility under this
category) even before I had hired his services !
EB1 has its own set of complex requirements for both the
candidate and the employer. I have been very impressed with the way Mr. Khanna could explain these and appeased the doubts/hesitation of my managers. I have found him to be very approachable, generous and always willing to help in just about every issue regarding my immigration and legal status in the US.
My case manager, Diane Lombardo, has been extremely patient, supportive and prompt in responding to my innumerable
queries. She was instrumental in preparing the petition very meticulously . Over the last several months I have
been amazed at her committment and helpfulness.
As I understand, EB1 cases are difficult and I believe Mr. Khanna and Diane Lombardo have used all their experience to handle this I-140 petition in the most professional and satisfactory manner.
Thank you very much to attorney Khanna and his team !
Many thanks to everybody for their patience, perseverance, and professionalism over the last 6 very long years. Sometimes I was about to give up, but this morning when I walked out of the DHS office, it's all been worth it.
Hi Rajiv ji,

I think Law office of Rajiv S Khanna has done a very good job in answering the RFE. After the RFE was answered, I got the approval in 15days.
In my offer letter, they have mentioned if they sponsor H1b I need to work with them for 5 years. What happens if I change the company by down the road within these 5 years?

Can H-1B transfer happen in such case from company B? If yes then if this transfer is approved but previous H1b extension is not approved which is from company B will it impact my status in US? Can I work for company B still? Will there be any chance that I have to go to India and come back with stamped visa ?

I have been scheduled for my interview next month after cancellation of the first one. I took three trips outside the US, and one last more than 6 months but less than one year. I waited for more than 5years since my last entrance which is June 2013 before applying for citizenship. Should I be worried about my interview since I broke the continuity of residency?

My boyfriend is applying for his F1 Visa in July 2020 for fall semester 2020 for his MS in Finance at one of the US universities (deciding on which one right now). This is a question asked well in advanced so we are fully prepared.

On 10 March 2020, a Washington DC Federal Court overturned the USCIS highly restrictive
standards applied to the consulting industry. This decision has a major positive impact on the IT
industry.
Judge Rosemary M. Collyer held that the USCIS must not administer justice through random
memoranda and must, if it wishes to change the regulations, do so through a formal process. In
fact, the USCIS seems to have illegally targeted the IT industry (“special treatment”):
