This question is raised often and debated much amongst lawyers focusing their practice on employment-based immigration. I have a call scheduled with a corporate client who is considering the legality of accepting a volunteer in their for-profit IT business.

The United States Mission to Nigeria is pleased to announce an expansion of the Drop Box Visa Renewal Program, tentatively to start of June 9th. This program allows certain visa applicants who have previously been issued U.S. visas to renew their visas without attending an interview.
My H-1 6 years are about to be over. No way to extend per lawyers. Can I move to CPT?
This is tricky. Usually CPT in the first semester is looked upon with suspicion by USCIS, unless: 1. yours is a graduate program; 2. the practical training is integral to the academic program; and 3. the employer has signed a co-operative agreement with the school.

Do I have to get a new visa stamp for my F-1 or can I travel back using the same F-1 visa stamp if my reinstatement is denied? I fell out of status because I registered for less than a full course load.
In my view, it is unsafe to travel on an existing visa after being out of status. If they become aware of your status problems, CBP, upon returning, can turn you back at the airport, or worse, even formally deny you admission thereby laying a five-year bar against reentry.
The Office of Foreign Labor Certification has posted updated program factsheets containing the FY 2014 Q4 TD selected statistics for the Permanent Labor Certification Program, Prevailing Wage Determination Program, H-1B Temporary Visa Program,
Appointments' procedures for all non-immigrant visas are the same. This is from my personal experience in Nov 2005.
Step 1.
Make the two payments - either by DD or cash at the designated branch of HDFC bank. Take copy of passport along. Get receipt of the payment. There'll be a barcode sticker on the receipt which will also have the number which will be your receipt no. for all future references. This can be done by the individual applying for the visa or any representative but should carry the Passport copy of the individual travelling.
On July 1, 2014, U. S. Citizenship and Immigration Services (USCIS) began using a new secure blue ink for many of its secure stamps.
Do we need to send an LCA for H-1B1 Singapore quota?
Yes, you do. E-3 visas for Australia and H-1B1 for Singapore and Chile, all require an LCA.
DHS will allow 13,999 CW-1 nonimmigrants for FY 2015
My sister filed petition for me last year maybe I-130. I am an Indian and my wife is Italian, I am in California nowadays since last week. Can we stay here permanently under I-485 or AOS whatever?
That category takes 13-14 years. During the time you are waiting for your priority date to be current, you cannot stay in the USA just because your green card is pending. You can, however, stay or come to the USA under a visa independent of the green card such as L-1, H-1. You can also apply for a green card in several categories simultaneously.
Can I get K visa for my spouse? I am a US immigrant with green card. Is there something called a V visa?
V visa no longer exists. There is no K visa option for green card holders. Sorry.
I encourage you to sign a petition I have drafted at the request of our community urging the Obama Administration to reinstate reissuance of nonimmigrant visas (including work visas like H-1, student visas like F-1, and family visas) within the USA, a practice that was discontinued in 2004. If the petition receives 100,000 on-line signatures by February 23, the Administration will review it, send it to the appropriate policy experts in the administration, and issue an official response. Signing the petition takes only a few minutes.
Following is a list of questions recently asked by a USCIS investigator of an H-1B employee working at a client site. If you are a member of our compliance group of employers, attend the free conference call scheduled for employers only on 7th July 2011. Membership in the group is by invitation only.
1. What is your name?
2. Can see your ID card?
3. How long you are in US?
4. Have you been visited your home country?
5. Who are you currently employed with?
6. How long have you been with your employer?
7. What is your job title?
What kind of problems can employment-based nonimmigrants (H-1, L-1, E-1, E-2, E-3, TN) face during reentry?
I think this question is most relevant for H-1 holders, but other employment-based nonimmigrants may also note the general principles here.
Quite a few of our community members have asked me about the basic laws governing adoptions. One of my colleagues has prepared brief write up for you.
H.R. 6080 has been passed and is expected to be signed by the President today, 13 August 2010. This Bill raises The H-1B and L-1 application filing fees (fraud prevention and detection) by $2,000 for companies with 50 or more employees in USA if more than 50% of the employees are on H/L status. The fees are to be effective upon enactment (when the President signs and USCIS can implement) and will end on September 30, 2014.
The Bill states:
