I don't really know where to start.  We started with another local immigration attorney with one candidate, but he insisted that a friend had gotten great results with Rajiv.  Our company is very loyal with local businesses and even attorneys :).  We went with Rajiv as this candidate was very persistent about his success rate and he was adamant that we HAD to use Rajiv's office.  Personally I'm very skeptical so I went out on the web searching for information about this "Rajiv", who seemed to in our candidate's friends eyes - walk on water.  I found myself looking at the C-SPAN video that is posted on the immigration.com web page.  That one video had me SOLD on his knowledge base, his compassion towards others and his eagerness to help those who did not understand to understand!  I was excited for our first conference call and I was not disappointed!  After that introductory conference call we all breathed a sigh of relief as we were very new to the H-1 process.  I had been designated the "H-1 EXPERT" for our firm so I knew I had to mesh well with Rajiv and his team.  I knew also after speaking with his H-1 Team and later his Green Card Team that we were all a perfect match.  Anna and Judi have been instrumental in pushing through TREMENDOUS amounts of documentation for H-1 transfers, new H-1 applications, and RFE's that we received from USCIS.  Jagbir and Rajiv's attention to detail on those issues was truly astounding.  We also have worked with Heather and Art with Green Card procedures and filings.  Heather held my hand through all of the advertising, postings, job descriptions, fees...I felt like if I made one wrong move I would be responsible for a denial in this process.  Of course my fears were calmed and I feel truly blessed to have come in contact with this firm.  I am truly amazed each time with all of their knowledge of these processes.  They are ALL always on top of things and great at getting POSITIVE RESULTS.  Even when technically our representation is done, they are there to answer questions as a courtesy to our company.  We are so very grateful for all of their assistance and we feel that we have a partner in the murky waters of immigration law.  We HIGHLY recommend The Law Offices of Rajiv S. J-2 to TN

Question details

I am Canadian citizen & currently working on TN visa. My spouse is on J1 visa. I want to switch to J2 and get EAD. After couple of years he will apply for waiver and will move to H1. I believe I will be switched to H2 automatically as his dependant and my EAD will be void. Will that be possible at that time that I can switch back to my TN status?

You can switch back to TN. To correct slightly, you do not automatically get switched to an H-4 (not H-2).

I had an accident and am on disability while my green card adjustment of status application ( form I-485 ) has been pending for over 4 years. My I-140 had been approved about 5 years back but my case has been caught up in the visa backlogs at USCIS and Department of State. I wanted to know if there was any provision for help in the immigration laws, in case I am sent for long term disability or my employment is terminated before I receive my green card. I learnt that employment and disability are subjects to be discussed with a benefits or employment attorney. The only immigration benefits are via AC 21 or via a private bill. Also, that one should not loose the advance parole anytime while the AOS is pending. I want to thank Mr. Rajiv Khanna for his generosity with time and expert guidance. Over the phone I found him to have a very pleasant personality. he had me feel comfortable and didnt seem money minded at all.

I had taken an appointment with Mr Khanna to discuss my H1b transfer filing to a new employer. Unfortunately the day of the appointment I got a call from the potential employer stating they will not be going ahead with my employment because of the visa. During the call I told Mr Khanna about the update and he refunded my appointment fees without thinking twice for which I am very greatful. And I am going to use Mr Khanna's office for my future immigration needs.

H-1B for Recruiter Position

A recruiting firm for accountants retained our services to file an H-1B petition for a recruiter. Typically, it is difficult to justify that the position of a recruiter qualifies as an H-1B level occupation. Our petition to USCIS argued, however, that even though recruiters do not generally qualify as a specialty level occupation, the present case is different because the beneficiary will be hired as an International Accounting/Finance Recruiter.
