I have retained the services of the law offices of Rajiv S Khanna for my Green card processing/filing. It has been over a year since the process started. In one word I would say the services that I received were "EXCELLENT" I would like to express my frank opinion and comments on some of the experiences 1. Even before the process started, Rajiv Khanna replied to my queries, concerns, questions within a few days of emailing him. This was even before the retainer agreement was signed. 2. LC: I was in a real hurry to get the process going since I had very little time on hand. I found that the people I had to interact with were able to put themselves in my shoes and actually try their best to speed up the paperwork required so that the application could be filed at the earliest. 2. I-140: Preparing ahead: On suggesting that we prepare ahead and have the I-140 application ready to be sent when the LC is received, I was happy with the co-operation, advice and support I received. As a result my I-140 application was sent to the INS just one day after the certified LC was received in the offices of Rajiv Khanna!! 3. I am sure the same kind of service will continue all through the process, and if past experience is any indication, I expect that my paperwork for 485 will be ready to be filed the day my I-140 approval is received by the Law office of Rajiv Khanna. 4. As for the fee arrangement, I really like the payment on monthly basis instead of one or two lump sum amount. Overall, based on my experience so far, I would, without hesitation, recommend the services of the Law offices of Rajiv Khanna for a Green card application.
When we were doing our research to find an attorney, Rajiv Khanna's law firm was very strongly recommended by a friend. In June of 1998 I changed jobs, and moved here to Florida in July of 1998. I began filing for new H1 visas in May of that same year. It took Just under two(2) months to get our H1-B and H-4. Just recently (Dec. 1999) our application for Alien Employment Certification, through the Atlanta DOL was approved. We are now in the process of filing our I-140 and, once the priority date becomes current, the I-485 (adjustment of status for GC). My wife and I are extremely pleased with the results Mr Khanna has been able to achieve since we first started with him in Maryland. We have come a far way, and it is refreshing to know that changing lawyers was the best choice we have made throughout this ordeal. I have completed my Bachelor's Degree in Computer Science Engineering (4yrs) and working as a Subject Matter Expert in US on L1B visa with a work experience of 4yrs. I have completed 2 Microsoft certifications and AICPCU certifications. Will I be eligible for processing Green card on EB-2 category ?
You will need 5 years of post-bachelor's experience. Certifications do not usually help.
I am an OT practicing here in the US and came from another country. I graduated with BSOT and had an OT VOLUNTEER work for 2 years in an adult setting back home. Would that count as a part of the 5 years experience? And from that 2 years, I was not yet licensed OT for the first 6months.
GENERALLY speaking, for EB-2, there is no requirement that I know of mandating paid experience. Volunteer experience could potentially be used.
I recently switched jobs and had my H1-B transferred from Company A to Company B. I have all the H1-B sponsorship documents in place from Company B.
I am married and my wife is on H4 visa. My wife is currently in India and she has a valid visa and I-94 based on my Company A H1. My wife’s visa and I-94 are valid thru Sept. 30, 2010.
My question is, although I have the all the approved papers for my wife’s new H4 visa based on Company B, instead of having her go for a re-stamping can she fly back on her old but valid visa and I-94?

I have come to US through my company with my L1 Visa. I am currently working with my client. There is an agreement between my company and my client not to hire my company employees within 6 months after quitting. I cannot move to any other company here in US as i am on L1. My company is not willing to file H1 either. If I have to move to a different company I should have a H1 Visa filed.
Recently my client offered me to join their company, but I don't have my H1 and i cannot join my client company even if i get my H1 because of the 6 months restriction. What are the different options to join my client.
This seems to be an issue of contract only. Immigration law does not stop you from changing.
