Hi Folks, I am extremly happy to inform you that I got my Green Card process completed in a record time of one year. I am just back from India after finishing the CP Interview in Chennai successfully. Mr. Rajiv , Ms. Fidelina Baptista and all his staff Suman Bhasin, Amel Berhe, Leila Lehman, Nimia were very helpful in the entire process. Needless to mention that Mr. Rajive is very good in handling EB2 cases. They did a great job in getting my labour and I-140 approvals and also cooperated very well in my persuit through CP instead of the regular I-485. During my I-140 stage, when I called and asked Mr. Rajiv that I want to opt for CP, he immediately agreed and accepted the challenge though it was not very popular at that time. I am extremly thankful to the entire Law office of Mr. Khanna without which I would not have got my Green Card so fast. I just got the I-485 approval yesterday in the mail and Rajiv informed me about it through an email. I am writing this feedback to let people know of excellent and extremely professional job done by the law offices of Rajiv S. Khanna. (all dates given below.) Rajiv used the RIR process for my labor certification, getting the LCA in a very quick 3 months time period. I had to wait for my PD to become current to file the I-485. My dates. Kelly has extended Temporary Protected Status (TPS) for eligible nationals of Haiti (and eligible individuals without nationality who last habitually resided in Haiti) through Jan. 22, 2018. As of May 25, 2017, USCIS has received a sufficient number of petitions to reach the maximum possible numerical limit (the “cap”) of workers who may be issued CNMI-Only Transitional Worker (CW-1) visas or otherwise provided with CW-1 status for fiscal year (FY) 2018. Although the FY 2018 cap has not been set, it is required by statute to be less than the 12,998 workers set for FY 2017.
Do the 3 years spent in residency training in an HPSA/MUA area be counted towards the five years required for NIW? The residency training (3 years) and subsequent job (2 years) were on H1B visa in two different HPSA/MUA areas but not processed through NIW route. Can the NIW petition be filed now retrospectively for those years already worked in underserved areas? My current GC sponsoring job is in a University teaching hospital (job designation Assistant Professor) but obviously also involves treating patients. The PERM prevailing wage category was teacher/ Professor but job description included patient care. Can the job be changed to that involving only patient care (no teaching) and still be considered same/ similar? How about a job (with patient care only & no teaching) in a private practice (as opposed to hospital employee)?

Ours is a long story. My green card was filed under EB3 India with a PD of May 2006. My husband's green card was filed under EB3 India in 2005. When our dates became current sometime in 2007, my I-140 was already approved and his was pending. So, we decided to go ahead with my case and filed for I-485 for both of us. However, the dates then retrogressed and our lawyer informed us that my husband's case is no longer valid since his LC expired 3 months after it was approved. We didn't know that LC expires if not used within a specific time frame and the lawyer did not inform us either. Anyways, my husband's GC was again filed, this time through Rajiv's firm with proper guidance and through EB2. Rajiv also guided us to go through Consular Processing instead of I-485 since in our case, my husband could legally work using EAD via the I-485 applied through my case. In all these years, the company I work for has increased in size and wants to promote me. I consulted with Rajiv regarding this and inquired about possibility for porting from EB3 to EB2. Rajiv answered all our questions and guided us appropriately this time too. We are now waiting to hear about the Priority Dates for October 2012 bulletin and will make a decision about EB3 to EB2 porting. It feels so good to be able to talk to Rajiv regarding these questions related to immigration and his knowledge and experience in this field is very very valuable for people like us. Every time we have talked to him we have received excellent response and guidance. My husband and the company he works for had a very good experience with EB2 filing.
