If you don. t know the secret beyond TEAM WORK read the following. It is the clearance of Labor Certification in California. Rajiv and his team members filed on 10th May 2000 for my Labor Clearance under RIR category. It was cleared at EDD Sacramento on 23rd of May and sent to DOL, SanFrancisco for further approval. Kudos to Rajiv and his team in getting our greencard approved in 1 year 7 months. Here are my details: EB2 India. Priority date: October 98. Labor certification was done via RIR in 7 months, I-140 in 2 months from TSC, and I-485 in 7 months from TSC. We had our passports stamped last Friday, and are awaiting our greencard. I originally started off with another lawyer, but changed to Rajiv shortly afterwards. That had to be the best decision we made!!! Rajiv and his staff are extremely knowledgeable and informative. He took no chances at all, and left no stone unturned in making sure our applications were complete. Believe me, this is the lawyer you want on your side.

It took about six months for our I-485 approval, in EB2, at Texas Service Center. Our priority date was 12/98. Importance of having continuity of employment/pay stubs

Whats the relevance or importance of having continuous pay stubs (How much gap is permissible if Not significant?) in the processing of Green card of an H1B holder.
Continued payments are required by law for H-1 holder, unless they come under some very limited exceptions for leave for employee's personal reasons. Not paying, exposes the employer to investigation and penalties and may place the employee out of status.
In the green card context, non-payment can lead to problems with demonstrating ability to pay wages.
For both H-1 and GC, nonpayment can lead to an assumption that no genuine job exists. That could lead to cancellation of one or both processes, except for situations where AC21 portability is involved.

DHS Implements Regulation to Enhance Attorney Discipline Program
The Department of Homeland Security (DHS) announced a new rule to enhance the integrity of the immigration adjudication process. The rule clarifies who is authorized to represent applicants and petitioners in cases before DHS; updates and enhances the standards and disciplinary procedures for these immigration practitioners; and eliminates duplicative immigration adjudication rules, procedures and authority.
The new rules and procedures published today in the Federal Register take effect March 3.
USCIS Provides Details on H-1B and H-2B Cap Exemptions for Work Performed in the CNMI and Guam
Introduction
Workers in H-1B and H-2B classifications who are admitted to perform labor and services in the Commonwealth of the Northern Mariana Islands (CNMI) and Guam are exempt from the H-1B cap and H-2B cap from November 28, 2009 to December 31, 2014. The Consolidated Natural Resources Act of 2008 (CNRA), Public Law 110-229, provides a special exemption to the statutory numerical limitations (or “caps”) for temporary workers in H nonimmigrant classifications mentioned in Section 214(g) of the Immigration and Nationality Act (INA).
The activity went smooth. Mr Khanna provided assistance in obtaining the visa for myself and the family.
