My family members and I have completed stamping at Chicago, IL. I am really glad that I chose Rajiv’s law firm for our GC processing. I have got all the help and support from Mr.Khanna’s law offices for my GC processing. The whole process went very well at every stage. I filed the application form for EAD with the help of our lawyer in the Atlanta office on January 8, 2004. Two months later we got the Notice of Action from Missouri office with two dates - Received Date: January 8, 2004 and Notice Date: March 8, 2004, which was a little bit confusing.
My EAD renewal (at VSC) had been pending for more than 110 days, so I decided to go to the CIS office in Bloomington, MN to get an interim EAD.On Jan 22, 04 the temperature was -10F with the windchill of -30F. I arrived at the CIS office at 7.25 AM. The office was already open. Inside, there were already 50 or so people in the line. The security officer gave me a ticket. After waiting in the line for an hour, I finally reached the security gate and went to the waiting room. It was 8.40 AM.
I got my Interim EAD card based on OPT.
I went to the Bloomington USCIS office (MN) around 4:20 am on Jan 7, 2004. As the weather was cold there were not many people. Somebody made a list and I was the fiteenth person.
Around 6 a.m, we made a line based on the list.
The office opened at 6:30 am.
The officer there started work at 7am. She asked me the reason why I was there and gave me a ticket. I got a ticket and went to another office.
Philadelphia district office EAD Interview scheduled 2.5 months after filing the marriage-based I485 package. People visiting for appointments need not wait in the line. The interview process is only taking a photo, leaving the finger print. the EAD card was printed out right away. The whole process took about 20 minutes, excluding waiting time in the waiting room.

8:50 am Got to the USCIS office.
I went at 10.15 am with I-140,I-765 and I-485 receipt, they gave me a token and new I-765 application to be filled up and called me at 2.15 pm. They checked the above documents, Passport and took my photo and gave me EAD instantly.There is no need to take separate photos and go.
Just wanted to share me and my wife's experience in at the Memphis Sub-Office on January 5, 2004. The Memphis office is severely backlogged currently in regards to AOS and EAD applications. We filed the I-765 for my wife on September 10th and hadn't heard anything. After corresponding with our congressional representative, we were told to travel to Memphis (a 350 mile trip) on any Monday to receive an interim EAD. We traveled to Memphis on Sunday to be ready first thing in the morning. Sunday night we decided to check out the office and went to the front door.
I had filed for my EAD renewal 3 months before the expiry date (September 16th). While my EAD was approved a little before 90 days, my wife's EAD was not renewed. They requested additional evidence (marraige certificate and I140 approval notice). After USCIS received the evidence and the USCIS website was updated, we went to Memphis on friday, January 2nd, 2004 (the day of the week when interim EADs are issued in Memphis) hoping that they would issue an interim EAD (since it was more than 90 days after the original receipt notice).
Excellent work done by team members in pleasantly, promptly and efficiently processing the H1B transfer for a new employee.
I am extremely pleased with the services provided by Mr. Rajiv Khanna and his extraordinary team in getting our Permanent Residence approval successfully. From the beginning, my case was reviewed (I started my process at around 3.5 years in to my H1 term) and I was given proper guidance to obtain the PR before my H1 expired. My wife and I got our Passports stamped in Orlando, FL after less than 2 years of process. The whole GC process through with Rajiv S. Khanna as our attorney and his office was a wonderful experience. My 6 year period of H1b visa expires in Dec 2010 and my labor application is still pending for approval. It was filed in February 2009. Am I eligible to apply for a visa extension , if so when should I apply for that? I assume I still have time.
H-1 extension beyond six years can be obtained under two circumstances:
First, indefinite H-1 extensions in one-year increments can be obtained, if the I-140 (or I-485) was filed and the green card process was started a year ago. The GC process is started for:
- Labor Certification based cases (including PERM) the date for the begining of the countdown is the date when the labor certification is officially received:
- for PRE PERM cases - by the local office (SWA); and
A USCIS memo to CIS Ombudsman responding to his recommendation states that USCIS establish more uniform filing and review procedures for motions to reopen and reconsider among field offices and service centers as well as improve communication of those procedures to customers and stakeholders.
U.S. Citizenship and Immigration Services (USCIS) issued guidance on requesting deferred action for surviving spouses of U.S. citizens who died before the second anniversary of their marriage. Surviving spouses qualify for this temporary program if they were married to, but not legally separated from, their U.S. citizen spouse at the time of that spouse's death; did not remarry; and are currently residing in the United States.
United States Citizenship and Immigration Services (USCIS) would like to clarify to associations and their members certain regulatory requirements for filing petitions for H-2B classification on behalf of foreign workers. We are issuing this clarification so that the public can be better informed of filing requirements and avoid unnecessary denials of individual petitions that may be otherwise approvable. We have noticed a particular type of filing error in many H-2B petitions filed by certain associations on behalf of their members.
Last week we received an approval for a difficult change of status RFE. We were retained to respond to an RFE for a client who had no ties to his home country (India). Six years of his H-1 were over and he was trying to get into F-1 status. He had been working and studying in Europe before coming to USA on H-1. We presented the facts of our client's background with complete honesty and sincerity. No games (which is the way all our cases are presented). I am glad to report that as has always been my belief, truthful presentation works.
U.S. Citizenship and Immigration Services (USCIS) is reminding federal contractors and subcontractors that effective Sept. 8, 2009, they will be required to use the E-Verify system to verify their employees’ eligibility to work in the United States. In July, Department of Homeland Security (DHS) Secretary Janet Napolitano strengthened employment eligibility verification by announcing the Administration’s support for the regulation that will award federal contracts only to employers who use E-Verify to check employee work authorization.
USCIS will accept the I-693 medical exam form with the 06/05/08 revision date, in spite of the 08/31/09 expiration date. This will continue till OMB approves the revised form.
