I was on H-4 visa from Feb 2014 till Dec 2015. I was on H-1 visa from Dec 2015 to April 2017. In April my H-1B transfer got denied. Hence I applied for change of status from here (April 15 2017) and now my H-4 application is under process. In Dec 2016 (while I was on H-1B visa), I had applied for GC in EB2 category with my employer. My employer told me that my labor has been approved.
1: Is there a website where we can check the status of labor if it has been approved?
2: When can I file for I-140? Is it true that it has to be filed within 180 days of labor approval?
3: Can my GC application continue whilst being on H-4 visa?
4. Does the GC process, at any stage, require the applicant to be on H-1 visa?
5: I am planning to start Canada PR procedure. Will my GC application interfere with Canada PR at any point?

Right now I'm in USA on B1 visa. I came last week 1st Oct 2017. Got the stamp for 6 months (i94 expires on Mar 31, 2018). This is the 3rd time I'm traveling to the US on B1. Below are the previous trip details.
Aug 02 2014 To Sep 28 2014, May 03 2015 To Jun 15 2015,3) Oct 1 2017 To till date (Nov 11 2017). Now my company wants to file L-1B petition for me. The employer is ready to file an application for L-1B in the USA if it is legitimate.
1) Now I'm already in the US, so Is there a process to get my L-1B without going back to my country (India)? Is B-1 to L-1B is a complex process? Is there any complication(s) if I put my petition in USA?
2) What will be the time frame to get L-1B?

This comment for Law Offices of Rajiv Khanna should be written 3 years ago. Sorry for the delay. My case was one of the most complicated and long-shot cases, regarding the fact that I was a diplomat in USA and my wife, as a diplomat Spouse (A-1 dependant) found a unique opportunity to work as a Senior Developer in a big company. After company's decision to sponsor my wife for GC, we didn't want to go with company law department, but instead decided to apply to Mr. Khanna and his staff to lead and guide us through the process. The reason for our choice was positive recommendations and all those admires happened to be true that my wife was able to get her GC in 6 months. Because of my diplomatic position, we were advised to hold my case and activate it when I was back home. We left US in 2008, activated my file by 2009, and as of 2011 my wife, our 3 y/o son and myself turned back to USA as permanent residents, thanks to Mr. Khanna and his proffessional staff which followed every detail and filing efforts precisely. We will definitely ask their assistance for our naturalization process.

I found working with Mr. Khanna and his team to be a pleasant experience. I changed my status from F1 to a Religious worker visa. I was very anxious during this process but I was at peace knowing that the people who were helping me through this process were able and competent professionals. Mr. Khanna was every personable and was eager to clarify all my questions. Also, Mr. Khanna contacted my employer on several occasions in order to explain the legalities involved in filing for the Religious worker visa, for this was the first time my employer had hired a foreign national. I would also like to express my thanks and appreciation to Ms. Anna Baker, who was my primary contact at the Law Offices of Rajiv Khanna.
This memorandum provides instruction to Immigration Service Officers who adjudicate R-1 nonimmigrant petitions for aliens who are coming to the United States temporarily to perform religious work, and their dependents. This memorandum outlines the procedure to be used for recapturing time spent outside the United States by R-1 nonimmigrants when seeking an extension of their R nonimmigrant status.

Topic: Accreditation of Distance Education in USA
Date: March 12, 2012

Hello, everyone. This is Rajiv S. Khanna for the Law Offices of Rajiv S. Khanna, P.C, immigration.com.
A number of people have asked me this question in the last few days about how do they tell, if they finish a masters degree online through distance education in the U.S., how do they know if the degree is accredited?
I have looked into this issue because it became such a big issue for people, especially those who are born in countries where EB-3 is very backed up and EB-2 is a much better option.
So I did some review. This is the best of my knowledge. I am not an expert in accreditations, but what I see is this. On the screen in front of you, you see this page where they talk about accrediting agencies recognized for distance education and correspondence education.
This is a page on the Department of Education website.
http://www2.ed.gov/admins/finaid/accred/accreditation_pg10.html
Let me backtrack for a second.
First thing you do is ask the school where you want to go whether the particular program you want to do is accredited and, if so, who accredits it. In other words, the accreditation agency that is accrediting it. Get the name, and see if that name appears on this list right here.
Sometimes a particular program or a particular degree might be accredited, but not the whole school, and sometimes vice versa. So be careful--make sure that particular program is covered by the accreditation.
Good luck to you folks and if you have further questions, log in to the community conference call or we can talk a little bit on the blog itself.
