I am EB2 priority date Sep2005. I had lost my job in Apr 09. I started working on Dec09 with another company similar job description, in same geographic location and with 15% higher salary than labor approved. I was out of job for almost 8 months.My old employer has assured not to evoke approved I140 (more than 3 years since I 140 is approved)
I have few questions:
1.Shall I file for AC21?
2.is it advisable to send copy of current paystunb with AC21, If yes how many months?
2.Is it okay to file AC21without paystub for around 8 months?
2.If I dont file for AC21, will there be an issue travelling on AP at POE?
AC21 should be filed. The fact that you were out of job for 8 months is irrelevant. As long as the jobs are same or similar, you should have no issues.

I just got back and I wanted to let you all know how it went, cause it felt like such an easy process, that I still can't believe it's over.
Our interview was at 10:00 am at the San Francisco office.
We arrived around 9:50 am (parking difficulties). We ended up parking at the corner of Sansome st., which costed $18. At that point I was so nervous that we were gonna be late, I wouldn't have minded paying $100 for parking.
First of all thank you for the very useful immigration.com website. Over the years I have used it frequently to check on the sometimes incredible information the INS (and successors) have told me and gauge how my progress through the INS labyrinth compared to others.
I was born in Mexico and I was brought to the US at the age of 3. Like many other people in my situation, I was brought here by my mom to provide a better education. I am now 18, just started college and due to my status I am struggling to keep up paying my tuition. I am forced to work, and feel that we should all get an equal opportunity in education. Through the years, I have acquired great knowledge thanks to the schools of this great country. I graduated from my High School with the third highest honors Ephebian, and a 3.33 GPA.
As I have used my CPT for more than 1 year at the same master level and already completed OPT for the 1st master and currently working on CPT for almost 2 years. As per Aug 8th, 2018 Memorandum Am I violating the rules and will start counting Unlawful presence from FEB 5th 2019? Or Unlawful Presence should be count from 6 months from FEB 5th 2019 which is AUG 5th 2019? If this is true then what are my options here?

I saw your video on doing business on H1b and understood most of the things such as applying concurrent H1b if I want to be actively involved in the business. I have 3 questions related to the topic. I will open an LLC or any other type of entity that my CPA will suggest but
1- I plan to start with a simple e-commerce business (selling online on a website and other platforms such as Amazon). How tricky is it to get approved for a Concurrent H1b for managing this type of business? I work in IT but I do have MBA and MS degrees from USA. I will be managing both the Technical and Management side.
2- I remember that Concurrent H1b will have to abide by all rules of H1b. Will this means that I have to have start-up capital of more than yearly prevailing wage of CEO in the bank to qualify? I plan to start with 10-20K.
3- Will this Concurrent H1b will be cap-exempt or I have to go through the lottery for this?
I think the problem here is I don't think we can prove that your job requires the Bachelors Degree, so unless the job requires the Bachelors Degree in a specific subject, we cannot get an H-1B for that job. There is no start up capital requirement for an H-1B. Directly there is no such thing, but of course indirectly the government can say that we want to be assured of the veracity of the company we want to know that you have enough money or start up money to secure the job. They usually don't ask.
Concurrent H-1B is cap exempt. It is not subject to the cap. If your main H-1B is already capped you have gone through the quota once concurrent H-1B will not be under the cap. The difficulty I see is that your job is not specialty occupation. Other than that, I think it can be done.
My wife H4 was expired and we realized about it one year after it has been expired. This has happened because my previous employer filed just my H1 and they never filed H4 for my wife. After realizing the situation my current employer filed through our company lawyer and H4 was denied. I have been looking around for another lawyer, who had success in handling this kind of case. I didn't find one single lawyer who can assure me of fixing my wife visa or who had success in the past. I sent an e.mail to Rajiv and surprisingly I got call from him the very next day and he told me about the success they had in the previous cases. We filed for my wife H4 along with my 7th year extension. Miraculously her H4 was approved by CIS.
