Let me first thank you for guiding hundreds of us with your valuable advice. My sincere thanks to you. I have a question regarding the inter-changeability of EB2 prority dates. I'm an Indian citizen and my wife is a Russian citizen, born in Russia. She will be filing as my dependent on my green card. I read on some online forums that I can user her country's priority date ("current" as of today) for the green card. Is this correct?
Yes, that is correct. This is referred to as "Cross Changeability."
What is time frame to return to the U.S?
A reentry permit gives you the permission to stay outside USA for up to two years at one time.
Is it a problem if a person wins a green card from the lottery but previously have been in USA with a tourist visa and has worked at the same time? The person have paid taxes and had returned in his country while still had a tourist status. But when he applies for the green card and when filling the forms what should he writes -that he has been with a tourist status but have worked? Is it possible that he may not be approved for the green card?
You have to tell the truth. You have paid taxes and returned within the time permitted on the I-94. I see no reason why it should impact your DV application.
I want to know if I can take the Green Card in my future. I am studing in Nursing courses right now, but can i take green card if I finish my Bachelor's degree? Please send me a response.
That is how most students get their employment-based green cards. Once you become an RN, under the current law, it should be relatively easy to apply for your green card. There may be other options as well.

Parents were in US July 2008, filed for an I-94 extension end Aug 2008 from Dallas, which was submit to VSC and subsequently routed to CSC their port of entry California. Extension was denied end Jan 2009 (guessing since they had extended 2 months the previous visit in year 2007). They left Mar 2nd 2009 (meeting the 30/31 day exit requirement).
Are they ineligible for GC? If so how long? Is there an alternative?
It does not look like they were unlawfully present for over 180 days. So, I don't see why there should be a problem with the green card.
How will i know if they already recived ( i mean is there a way to trck it) my application for the change of status (I-485). i sent that last april 29, 2010....how long do i have to wait for the responds from the uscis....
You can verify delivery (if sent by Fed Ex, UPS, etc.) and also check with your bank if your fees checks were encashed.

This applicant was highly qualified and known in the field to be one of the few that have reached the highest level of success. He was very well published with over 90 publications and authorship of a multitude of book chapters. We provided extensive documentary evidence to show that he was one of the premier surgeons in his expertise. This applicant was frequently called upon as an invited speaker and presented his work worldwide.
We won a case for a Materials Scientist who had over 11 years of research experience. His expertise was in the field of solar and hydrogen powered energy. We provided documentary evidence to show that his extensive list of publications was in prestigious international journals with high impact factors. We also showed that as a result of his innovative and pioneering work, he was invited to present his findings at a large number of conferences/workshops and symposia.
This applicant had over 5 years of industry experience and 8 years of research experience. He was offered a job with a private company conducting antennae and microwave engineering research. His unique skills set him apart from other researchers in the field and as a result he received several significant awards for his outstanding achievement. He also published for the prestigious society, IEEE.
We won this case following a Request for Evidence, which included requests for further documentary evidence to show that the grant awards received were considered "highly competitive" and awarded based on the applicant's outstanding achievements. We provided documentation to show that the applicant was featured in major media for his innovative work. We provided additional expert letters that reiterated the applicant truly stood out amongst his peers and more than qualified for the category.
To give you folks an idea of what gets through easily. We won a case for a chemist with over 14 years of teaching and research experience. This applicant was the author of over 63 peer-reviewed research publications and presented his work at 17 conferences and symposia. He was also invited to present at a multitude of seminars. This applicant authored 5 book chapters and technical proceedings. He qualified for the category based on his extensive publication record as well as his acting as a judge of others' work.
We won this case following a response to a Request for Evidence. Service requested further clarification on the "permanency" of the job offer, which was with a University. We submitted an official job offer letter as well as the copies of the university personnel manual and administrative handbook. Service had requested additional evidence to show "international reputation" of the applicant.

On Aug. 19, the U.S. Department of Education (ED) announced that it no longer recognizes the Accrediting Council for Independent Colleges and Schools (ACICS) as an accrediting agency. This determination immediately affects two immigration-related student programs:
My parents who are green card holders applied for the i-131 travel document in Sept 2021. They finished their biometrics in Oct 2021 and left the USA on Nov,14th 2021.
There has not been an update to the case after the biometrics. Do they need to return to the US by Nov 14th, 2022? Or can they wait till the I-131 application is processed before returning to the US?
If they can come back before November I think that would be a good idea just to be safe.There is no guarantee that the reentry permit will be approved, although it is very rare for reentry permits to be denied at least for the first two years.

I am currently on STEM Extension and my visa expires in July 2023. I also have a masters degree here in the states. I wanted to know what my options are..
If the suggestion is Day-1 CPT, I wanted to know how safe/legit it is! I have heard that going on Day-1 CPT can cause some issues when your H1 gets picked and may lead to RFE?
It is legal and so far it has been safe. You know that the rule for Day 1 CPT requires that when you join, you are associating with a graduate program otherwise you cannot get a Day 1 CPT. The Curricular Practical Training is an integral part of your degree. You cannot finish the degree without the practical training. The other thing is the employer signs the cooperative agreement with the university. The only additional suggestion I have is if you are going to do Curricular Practical Training make it as an adjunct to your profession.

I have worked in the U.S. under L-1\H-1B from June-2015 to March-2020. I have been in India since the last 2 and half years (Not working for any US based company). Now I have got Job offer from a US company and the H-1B I-797 petition is approved. I have a previous employer's H-1B Visa stamp (which expired last month) in my current passport, and B1/B2 Visa stamp(got in 2013 and valid till Sep-2023) in my older passport. I also have approved I-140 (EB2) from my previous employer.
My Question is due to the high wait time for Visa appointments, in worst case, if I can not secure a visa appointment anywhere close to joining date, can I travel to the US with a valid B-1/B-2 Visa and approved I-797 and later change status to H-1B and join the job? If yes, would it impact the GC process in future?
I would strongly recommend against it. I think you would do a lot better trying to get an H-1B Visa stamping in a third country. People are going to places like Singapore, Hong Kong and Maldives. Look around India and you might be able to make an appointment.
