We recently had an issue with my cousin's OPT status. She is in 'CAP-GAP RELIEF' category and needed to travel to India for her wedding. Rajiv provided his guidance and advice on several things relating to this issue. He informed us of all the Pros and Cons of travelling while in CAP-GAP extension. He guided us contact the 'right' authorities to get some of the answers. We totally appreciate his time and valuable advice.
I encourage you to sign a petition I have drafted at the request of our community urging the Obama Administration to reinstate reissuance of nonimmigrant visas (including work visas like H-1, student visas like F-1, and family visas) within the USA, a practice that was discontinued in 2004. If the petition receives 100,000 on-line signatures by February 23, the Administration will review it, send it to the appropriate policy experts in the administration, and issue an official response. Signing the petition takes only a few minutes.
As of 27 April 2012 count, USCIS has received 29,200 regular cap H-1 B petitions and 12,300 advanced degree H-1B petitions. These numbers are considerably higher than the ones we saw at this time in the fiscal years 2011 and 2012 (we are now in FY 2013).
My H-1B status will expire the last week of January 2013. I cannot file my petition for an extension until after January 1, 2013. Will that be too late to file an extension?
A petition is considered to be timely filed as long as it reaches USCIS prior to the expiration of your current H-1B status.
Is a transfer possible from a cap-exempt to cap H-1B?
It is possible. You will have to follow the April-October time frame, except where you apply for concurrent cap employment to run together with your cap-exempt employment.
I have known Mr. Khanna and his team for over 15 years now, and have exclusively used their services any time there has been an immigration related need personally or for my organization. They just have a knack for getting things done and I will unequivocally recommend their services to anyone.
I am working for my employer in H-1B status, but another company has offered me a better position. Can I just transfer to the new company with my H-1B approval?
When an H-1B foreign worker would like to change employers and continue to maintain his or her current H-1B status, an I-129 petition must be submitted to USCIS by the new employer or its representative. The forms in this case will be treated as a new petition and will require the appropriate filing fees.
We had the best experience working with Mr Rajiv Khanna and his staff. They were very knowledgeable, friendly and supportive in processing H-IB visa for one of our employees. the staff was very detail oriented making sure they had all the correct information before filing the petiton to USCIS. ,and the turn around time was very quick . they tried to understand our situation and provided appropriate responses . Mr Rajiv Khanna was , always there guiding us through the process through conference calls. Fran and Anna were the best , they were very very helpful, and supportive in every step and made the H-1B process go very smoothly.

Regarding Part 6 of Form I-129, does USCIS require a copy of the export control license if one is necessary?
No. At this time, USCIS does not require a copy of the export control license as part of the nonimmigrant visa petition process.
Will a petition be denied if an export control license is required but has not been obtained prior to filing the petition?
No. USCIS will not deny the petition on the basis that a license is required but has not been obtained prior to the filing of the petition.
Where can I obtain additional information about the export control regulations?
DOC’s Bureau of Industry and Security (BIS) administers the Commerce Control List (CCL) and is responsible for issuing licenses under the EAR. Information about EAR and how to apply for a license from BIS can be found at www.bis.doc.gov. Specific information about EAR’s requirements pertaining to the release of controlled technology can be found at

Law Offices of Rajiv S. Khanna, is one of "THE BEST LAW FIRMS" to work on your immigration issues. The attorneys and paralegals are very easy to get to and respond to your needs immediately. This is essential for your case to be "Successful". I especially appreciated your attention to detail and prompt responses from "Rajiv" and Heather working on my case. They are very knowledgeable, creative and well determined and excellent quality of work and well documenting the process towards success. I have no words to say much how I am thankful to Rajiv. We filed an H-1 application for a Bonsai Nursery/Facility Manager. USCIS issued a Request for Evidence (RFE) challenging whether or not a specific Bachelor’s level education is required for this position. We filed a detailed response, with voluminous evidence the specialized nature of the job. We urged USCIS to consider the merits of the job description and what it would take to perform the job. We argued job titles alone are not dispositive of the nature of a job.
USCIS approved the application.
I'd like to thank Law Offices of Rajiv S. Khanna, for all the assistance with my case. The whole GC process through your offices was a real pleasant experience. As I am mentioning below, it took USCIS 6 years to adjudicate this case, when it was transferred from my former company, but it was possible only because of prompt intervention from your side and finding the correct resolution for this problem. I couldn't say that it happened by itself - it was truly a collaborative effort between Mr. Khanna and all other people of Law Offices of R.S.Khanna, my current company, my former employer, and last but not least, support from my family. Unfortunately, it showed how inefficient the government could be in certain aspects, and only diligence and persistence turned this into a success.
There was a complex RFE for I-485 AOS based on employment 2 years ago, which involved a H1-b denial of extension for former employer, handling status during that period, new H1-b, and travel to home country for visa stamping.
I’d like to thank Mathew Chacko for handling my case and all aspects of it.
I'd like to mention the diligence of Bharathi for answering to my emails almost instantenousely.
I'd like to thank Mr. Iqbal for stepping in and making sure about timely communication with USCIS NSC.
I'd like to thank Leslie and Prernaji for helping with other matters.
If you need your complex case done right, don’t hesitate to contact Mr. Khanna and his wonderful team.
