My H-1B visa is going to expire in 01-Jan-2018 and if my employer submits my PERM application in the month of June (i.e. before 6 months of my current 6 years of H-1B visa duration).
1) If my PERM gets approved before my current H-1B visa expires (i.e. before 01-Jan-2018).
Would I be eligible for a H1B extension for 1 year since my PERM was approved before the current H-1B expiration?
2) If my PERM gets approved after my current H-1B expires can my employer file for H1B extension of 1 year since my PERM is approved now.
3) If my PERM is not approved before my current H-1B visa expires.
Would I need to go back to India?
4) I spent about 2 months (on vacation) in India. Can these 2 months be added back to my current H-1B visa? or this can only be added if my current employer files for my green card?

I am a permanent resident, a citizen of Poland. I want to study medicine in Poland. The program lasts 6 years. I don't want to abandon my status and want to understand if such long-term abroad is possible. If I am not mistaken GC holder can be away 6month-1 year. But, since I'll be out of US on regular basis, so it's best to apply for a reentry permit?

I am in I-485 pending status based on EB2 and have been working on EAD since 2012. Under the new rules effective January 2017, I understand that I can file for EAD extension 180 days prior to expiration. Will EAD be considered extended automatically if the approval doesn't come before the expiration of my current EAD?

I am a US citizen and would like to sponsor my brother for Permanent Residency. How long would it take for him to get Green card.If I file green card for him, does his family (His wife and kids) automatically get green card or should I file for each of them? I think I should for all. Just a question? He gets a EAD (so he can start working) when I file Green Card?

This has been quite an amazing journey towards my citizenship. People have been super nice and responsive.
I arrived in the US in Jan 1995 (so I have lived here in the Cleveland area since then, roughly 21 years - went to College of Wooster). I got my greencard in 2001 (had it for the past 15 years) and now I am ready to be a US citizen!
They received my package on March 14.
My biometrics was on April 12th (29 days from application)
My interview is on May 23ed. (2 months and 10 days since application)

Rajiv, Diane, June, and Kunal worked with me to get my EB1A approved. I shared my CV and credentials with Rajiv ji just as I was graduating out of my PhD and again got in touch with him after a year. This time he showed conviction in my profile and that gave me the confidence to move forward and apply for EB1A category. The team's efforts in preparing my file and insights in my case were tremendous. I just got my EB1A approved, all thanks to this team. I listened to their advice and had faith in their guidance and would suggest others to believe in them. If they say there is a good chance, then there probably is. They have years of experience in this field. I strongly recommend Rajiv and team for help related to immigration.
I am a Registered nurse present in the US with F-2 visa stamp on my passport. My husband, being in grad school, has 2 more years of valid I-20. An employer sponsored me the green card, and recently I received my EAD based on I-485 application. But both my I-140 and I-485 are still pending. The employer wants me start working although my I-140 is pending.
1. Do you recommend to work on EAD while I-140 still being pending?
2. If I use that EAD, and by any change if I-140 is denied later, should I leave the USA to avoid unlawful presence? How can I come back to F-2 status again?

My employer ended my employment due to COVID reasons on May 31, 2020 but I never received an official termination letter. Calculating the grace period depending on the assumed termination date mentioned above, I have till July 30 to find a new job. Should my new employer give me an offer or start the H1B transfer application before July 30? What happens if they fail to do so in time? Can I extend the grace period on the basis of having an offer in hand or maybe because of the pandemic? My final interviews with potential employers are being withdrawn because of the time restriction.

I strongly recommend Rajiv S Khanna's firm for amazing services, excellent case preparation, legal advise and great team work. We have taking all our Immigration legal services from Rajiv in past 10+ years for H1, GC and other immigration related matters. Thanks to Rajiv and Heather for successful approval of my I-140 approval. Journey started with some questions as student visa holder where Rajiv answered all of my questions with full patients and at the end of call he Refunded my fees bcoz he doesn't charge any fees to students. Next was H1b process where my chance of approval was very slim and the company was at its starting phase. Having no options on table we took a chance, with Rajiv's skills and tremendous experience he made the case that no one can deny it and we got it approved. Same thing with I140 stage where also chance of approval were very slim due to change in conditions of business, he offered me to abandon the case in middle and save his fees which I think no one in his profession would do that. Then we decided to put some faith in god and Rajiv' S expertise as we already knew he can make the case with any situations. and here we go I140 approved.............Hoorey.............he did it. Thank you you are the best ...
