Adjustment of Status Filing Charts from the Visa Bulletin
If USCIS determines that there are more immigrant visas available for a fiscal year than there are known applicants for such visas, USCIS will state on this page that you may use the Dates for Filing Visa Applications chart. Otherwise, USCIS will indicate on this page that you must use the Application Final Action Dates chart to determine when you may file your adjustment of status application.

U.S. Citizenship and Immigration Services today issued policy guidance (PDF, 322.3 KB) on how USCIS analyzes an employer’s ability to pay the proffered wage for immigrant petitions in certain first, second, and third preference employment-based immigrant visa classifications, including instances when the sponsored worker is changing employers.
