I've just started my GC process with Mr. Khanna's firm. They are about to send my DOL LCert. While working with them since last few weeks, I admire there professionalism and dedication. I began my GC processing in October 1999. And got my LC done in December 1999. I really thankful to Mr. Rajiv and his team for their efforts. Now I am in process of filing for I-140. In June of 1998 I changed jobs, and moved here to Florida in July of 1998. I began filing for new H1 visas in May of that same year. It took Just under two(2) months to get our H1-B and H-4. Just recently (Dec. 1999) our application for Alien Employment Certification, through the Atlanta DOL was approved. We are now in the process of filing our I-140 and, once the priority date becomes current, the I-485 (adjustment of status for GC). My wife and I are extremely pleased with the results Mr Khanna has been able to achieve since we first started with him in Maryland. We have come a far way, and it is refreshing to know that changing lawyers was the best choice we have made throughout this ordeal. My Question is after getting green card and leaving consulting employer after 14 months, when person applies for US Citizenship (8 years after getting green card) can USCIS ( knowing that sponsoring company was consulting) asks for client letter, contracts ( like H-1B documentation ) for the period when employee was working with GC employer( after GC approved) ?

I am currently on F1 visa and working on CPT. My H1 petition was picked in the lottery this year and status changed to RFE 2 weeks ago. I wanted to know if August 9 unlawful presence rule applies in my case i.e; if I get a response for RFE after Feb 4 2019, that completes 180 days.

In Summary, <br>
* I worked for the same Company from 2004 to 2014 (2004 - 2011 in US on H1B, and 2011-2014 in India)<br>
* BUT, after Green card, I did not work for the Company in US.<br>
* I don't have even a single paycheck from US Company after receiving GC.<br>
* Since then, I have been working in a job with same job description that my GC was filed for.<br>
* All other history is clean. I have two US born children, Always paid taxes on time, no legal cases.<br>
I heard from reliable sources that under current circumstances, my case will be marked as fraud and there is a 99% chance that they will revoke my GC and deport me, as I didn't stay with the employer that sponsored my GC.

I had EB-2 I-140 with PD of March 2017 , My EB-1 I-140 is Aug 2018. My attorney has filed for amendment of priority date - How this works , will they open the case again ?
How long will it take to get the amended I-140 with old priority date.

Effective immediately, the categorical CNMI parole programs are terminated. This affects USCIS parole programs for immediate relatives of U.S.
My wife and I got the I-485 approval in March 2008. We filed the I-140 & I-485 in February 2006. The LC PERM was done by Rajiv’s law firm too. The I-140 was approved in 4 months without any issues.
Mostly I dealt with Prerna Mehta and Jitesh Malik. Both provide me excellent help and support during the process. Malik called me on my cell phone to answer my questions, and he was polite, fast and correct. Also, I praise Prerna for checking my documents and forms thoroughly and providing correction/feed back immediately.
My sincere thanks to you Mr. Khanna, for all the help and guidance that you gave us through out the application process. You were always ready to answer all my questions and I really appreciate all the help that you provided.

My 485 was denied and I had only 15 days to respond back or else I would have lost my EAD too! I came to know about Rajiv from a friend and emailed him right away, the same evening I got the denial letter. Next morning, Rajiv called me personally and collected all the details from me. At that time, he wasn't even sure if he is going to take the case or not. My 485 was based on family and I had done all the paper work myself. I had my initial interview 2 years back (in 2006) where I was asked to provide my original birth certificate within next 90 days. That was the only thing needed for approving my 485. I had sent my hospital issued birth certificate shortly after that. Since then I never heard back from USCIS. After a few info-pass appointments, I got a denial letter in Feb 2008.
The USCIS procedure mandates to send a letter of "Intend to deny" if the evidence they ask for (birth certificate in my case) is not satisfactory. I never got the intention letter. Instead, I got the denial!
The case was complicated but Rajiv took the time to research how to proceed and finally he suggested we appeal via form 290B (Motion to Reopen/ Reconsider). Mathew and Suman promptly created all necessary paperwork. I managed to get the municipality issued Birth Certificate and we files the Motion to Reopen within 10 days of receiving the denial letter. USCIS took a little over a month and approved my motion.
Now I just have to wait for my 485 to get approved. I was very pleased to find Rajiv and his team. I wish them all the best in the endeavor to help thousands of people with USCIS.
