Hi, My wife and myself received our I-485 approvals the last saturday. Rajiv, Fidelina and their team did great job in getting my GC. I didn't have lot of time on my H1 when I started my GC (right around 2years), but I got my GC within 1year 8 months. Here are my details: EB2 India, PD is Sept 98, LC done in 7 months through RIR, Got I140 in 3 weeks. I485 RD is Aug 99. Got EAD/AP within 2 months. FP done in Oct 99. 485 approved May 23, 2000. The best thing I did is hiring the Rajiv and the gang instead of going through the company lawyer. I saw my friends in my company having lots of troubles with the company attorney, who doesn't have current knowledge of ever changing immigration laws. Great job guys! Thanks Puri
Hi Folks: I hired Rajiv and his associates for my RIR Labor certification in the state of California and got it APPROVED IN RECORD TIME. Details: Priority Date March 20, 2000. EDD Sacramento fowarded to DOL, San FRancisco on April 13. DOL recd my app from EDD on April 17 and APPROVED it on APRIL 28 (11 days at DOL). Total time from EDD to final DOL approval: about 5weeks ONLY. Before I hired Rajiv, he had mentioned 5 months for another case he had handled in CA. Mine really stumped him. I am currently in the U.S. on an L-1 visa. My fiance is Hungarian and currently visiting me on a tourist visa. My L-1 was issued in Tokyo, Japan. Can we get married in the U.S. and get her an L-2 visa without her having to leave.
My fiance's mother wants to visit him , but his income tax for 2009 not enough to sponsor his mother. Can I put my income tax to co-sign to let his mother get the visa visit US ? If its work how much my income should be that would qualify with the situation ? ( i'm a single mom with 2 kids).
Whats the relevance or importance of having continuous pay stubs (How much gap is permissible if Not significant?) in the processing of Green card of an H1B holder.
Continued payments are required by law for H-1 holder, unless they come under some very limited exceptions for leave for employee's personal reasons. Not paying, exposes the employer to investigation and penalties and may place the employee out of status.
In the green card context, non-payment can lead to problems with demonstrating ability to pay wages.
For both H-1 and GC, nonpayment can lead to an assumption that no genuine job exists. That could lead to cancellation of one or both processes, except for situations where AC21 portability is involved.

U.S. Citizenship and Immigration Services (USCIS) is alerting customers of certain Notices of Approval (Forms I-797) issued between Jan. 20 and Jan. 27, 2010, with incorrect or missing information. The form types impacted are Petition for Nonimmigrant Worker (Form I-129) and Application to Extend/Change Nonimmigrant Status (Form I-539).
U.S. Citizenship and Immigration Services (USCIS) announced the availability of a revised Medical Certification for Disability Exceptions, Form N-648, for public comment.
We applied for my extension for my H1B in December and got the approval before the end of January. The entire process was seamless and the support we received from Fran Fisher and Anna Baker was exemplary. I tried 2 different attorneys before employing law offices of Rajiv Khanna, one attorney took money but didn't even bother to call me and other who wouldn't fill the basic information properly before filing the application for LC. Myself and My wife, we got our passports stamped yesterday (11/21/2002), the whole process took us about 2 yrs and 1month without any problem or query from INS.
