Thanks to Rajiv and his team. My LC was filed in Nov' 99 and got approved on Nov'12th 2000. Applying for I-140. This team is very prompt, patient, energetic and knowledgeable. The team reply to every question very carefully. Rajiv even replied to some personal immigration questions when I need to change my wife's H4 status to F1 (we went to Mexico for this). Thanks to Rajiv for all his answers and suggestions. GC is a major milestone in our life, for those who want to make a career in U.S. We need patience and above all must follow the attorney's suggestions for successfully getting the GC.
Green card experience : I would like to thank Mr Rajiv Khanna, Fidelina and their staff for all the help they provided through my Green card process. I am glad I selected them as my lawyers and would recommend others too if they want a hasle free green card processing. My Labour was done in Feb 98 and it came in under 6 months. We tried for EB2 I140 but since I did not have masters, we got an RFE. We selected EB3 as an option then but due to some confusion at the VSC side, my I140 was denied, they thought we are asking for EB2 again. My date had luckily become current at that time. Due to the quick response from Fedilina, my 140 was approved in about a week or so. That was something really extraordinary and I am glad Fidelina was handling my case. We are able to file 485 at that time, Aug 99. Got the EAD in about 3 months. But unfortunately, the dates went back. At that time, my wife’s 140 got approved in EB2 and through another lawyer. Her date was current. We were in a dilemma whether to file another 485 while earlier 485 was still pending, do CP or just wait. We finally decided to go for CP. We had our interview on 25 October at Delhi and had to wait for 2 weeks at delhi because of Name check problem. Fidelina had been nice to answer my queries every now and then through the whole process. The CP process was very smooth without any problems. If anybody has any specific question, please write to me at KHERAA@YAHOO.COM and I will be really glad to answer.
Rajiv's staff is well informed, prompt and very friendly. I had no problem during all the phases of processing. I received prompt response to my emails and Rajiv or his staff members were easily available to answer any questions. Further he has a real good system to organize and store documents; because of which I never had to refer to any of my old documents over the course of my 3.5 years of Green card processing. Further his consultation fees are reasonable. I would recommend his services.
I had an interesting N-400 interview yesterday. Don't know where to start but the IO stemmed out of the office with my thick file while I was waiting for my attorney to arrive. I quickly summed him up to be a hard ass. BTW, I have been an officer of the law for a little over four years now...My attorney arrived shortly after and we went to this small conference room. I was sworn to tell the truth, and the interview started.
I am glad that i chose Rajiv Khanna for my GC. These guys are just incredible. Special thanks to Amrita for making the PERM process as smooth as possible. Its been a pleasure so far to work with Rajiv's team and i am confident that it will be.
I would like to thank Ms Amrita for her patience and professionalism in preparing all the necessary paper work for my PERM application. She is very diligent and explained carefully what my employer had to do for the application. Thank you for the excellent work.
Great work, splendid support, excellent work ethics and prompt responses - a few of the words I've to describe the team that processed all the paper work needed for my Labor Certification. I got the labor certification completed in about 2 weeks, somthing that I didnt anticipate at all.
Glad to have continued on with Mr. Khanna's team for my GC processing after successful H1 processing. Sincere thanks to Mr. Vijay Durgam, Ms. Pramita & to Mr. Khanna for their support and hard work.
I have no hesitation in recommending their services to any one looking for immigration related assistance.
First of all thanks and Kudos goes to 'Subha Chennubhotla': my Case Manager; who made this first step successful. My labor got certified less than 3 months. She did make sure all the paper works was done properly and checked with me several times before the filing.
I would also like to thanks the whole Team who worked on my case behind the seen and made this far successful; also to the rest of the team with Law Offieces Rajiv S. Khanna.

Hi,My name is Kanchana and the Law Offices of Rajiv Khanna have processed my LC through the PERM process. I must say that a great job was done by them especially Vijay Durgam and Pramita , in promptly following up with our paperwork and doing the needful. I got my LC Certified in sweeping 7 days from the date filed. Their knowledge in this field is commendable and I thank myself everyday that I chose to go with their law offices. My complete vote for them and I only hope the rest of the GC process goes just as smooth.
Great work guys, thanks once again.
Case: Picked for H1B lottery.
- What happens if the company lays off after June but before October 1? Would I stay on my current visa status? Or will I be on H1B but with a 60-day timeline to find the next job?
- Does the status automatically change to H1B on Oct 1? or does immigration require paystubs for a couple of weeks to prove our employment?
- If I file the petition with two companies separately, how will immigration decide which one to approve? Will they approve both?
- Are there any travel restrictions from June to Sept
In this scenario, you won't be on H-1B status with a 60-day grace period to find a new job.
I started the self-NIW application while working with employer A, but for some reason, I could not file the petition. Later I got laid off from employer A and now I'm working with employer B.
I want to restart the NIW application. Questions:
1. Since I got laid off with employer A, will that be a challenge/red flag in my petition?
2. It's only been one month with employee B. Shall I wait some time at company B to restart my NIW application? or doesn't it matter?
Answer 1. Being laid off is not a challenge/red flag.
Answer 2. There's no reason it should be. You don't need to wait to restart the application. You can file it even though you've only been with employer B for a month.
1) Is H1B cap-exempt to H1B lottery-based considered a change of status?
2) If I currently have an H1B cap-exempt visa and am filing for an H1B petition in June, when can I not travel outside of the US - from now to June, June to Petition Approval, or from Petition Approval to Oct ? My current H1B visa would be valid until Nov.
Yes, potentially. It allows you to work while your STEM OPT expires (April 30th in your case), and your H-1B petition is pending, extending your work authorization until October 1st.
