A Washington DC Federal court has held that DHS improperly promulgated the 2008 regulations creating the 17-month OPT CAP GAP extension for STEM graduates (strictly speaking, this is not reallly "CAP GAP" issue). According to the court, DHS should have placed the proposed regulation before the public, allowed everyone to comment, considered the comments and then published the final regulation. Thus, DHS violated the procedural mandate requiring "notice and comment." According to the court, there was no good reason to skip the "notice and comment" mandate.

Secretary of Homeland Security Jeh Johnson has extended Haiti’s designation for Temporary Protected Status (TPS) for an additional 18 months. The extended designation is effective Jan. 23, 2016, through July 22, 2017.
My experience with Rajiv's organization has been fantastic. His understanding of the nuances of the immigration laws are highly valued by my organization.
My point of contact was Diane who was a delight to work with. She gave me detailed instructions at each stage and periodically followed up when there was any perceived delay.
I would most readily recommend Immigration to anyone who needs any service related to immigration.

I am a US Citizen residing in the UAE with my Wife and two children. My Wife is a Syrian passport holder. We petitioned her case for residency in the US under I-130. We have received the first notice from the NVC which was on the 24th of June. The letter stated that all documentation necessary to complete the National Visa Center processing of your case has been received, and as soon as an interview date has been scheduled then we will be notified.
How long does it take to receive the second notification with an Interview Date that we are closing on week eight?
Is there a way that you can expedite an Interview Date?
If the answer is Yes, Could we officially request your service?

Hi Loay. Times are highly variable from a few weeks to a few months. Expedites are only granted for showing of some sort of urgent humanitarian situation in cases like yours. We would like to help, but I am not sure we can add much value at this stage. Contact us if there are any issues (other than timing).
How does it work with financial co-sponsorship? Can a family member or a close friend co-sponsor a fiancee?
Anyone who is a US Citizen or green card holder can co-sponsor affidavits of support .
My wife H4 was expired and we realized about it one year after it has been expired. This has happened because my previous employer filed just my H1 and they never filed H4 for my wife. After realizing the situation my current employer filed through our company lawyer and H4 was denied. I have been looking around for another lawyer, who had success in handling this kind of case. I didn't find one single lawyer who can assure me of fixing my wife visa or who had success in the past. I sent an e.mail to Rajiv and surprisingly I got call from him the very next day and he told me about the success they had in the previous cases. We filed for my wife H4 along with my 7th year extension. Miraculously her H4 was approved by CIS. This has just happened definitely because of the excellent background work done by Rajiv and his team. The timely response from Rajiv,Jitesh,Ursula,Anna & Seth is extremely impressive. I recommend anybody to deal your immigration issue with Rajiv and his team. These guys are just awesome. Overall I am very happy that we chose Rajiv firm.
Excellent services. Got approved without any ref or other problems.
Good experience.
I have contacted you in the month of June, 05 regarding my F1-H1 Issue. My H1-B visa was approved by the American Consulate in Mumbai with out any problems and I am in the US right now. I would like to genuinely thank you for all your help and advise and I am glad that I took your services as I tried a number of lawyers before you and everyone gave me conflicting advises. I am writing to you my whole experience in detail so that you can put this in forum as other people may get help from this.
Thanks to Rajiv and his professional, friendly staff for their phenomenal work on our Green card case. We just got our cards. Rajiv was meticulous, comprehensive, and incredibly skillful in preparing the case. Over the last three years, we had some really nerve wracking moments, but Rajiv’s prompt response to our concerns had been a beacon of hope and comfort. We never had to wait more than a few hours for his response to our emails. This promptness meant a lot to us. We are very happy that we chose Rajiv as our attorney, and we recommend his firm highly to anyone seeking immigration benefits. Once gain a heartfelt thanks to Rajiv, and his staff.
Very professionally done! Mr. Khanna took personal interest and answered e-mails/questions promptly. He has made yet another permanent client!!! His staff was also very patient. His fees is very competitive and there are no fees for 'providing information' on the phone, a practice of many immigration lawyers.
My interview was done on December 11, 2012 For n 400, I passed the test but the officer gave me a letter saying that the decision cannot be made now.. Two days later I received request for evidence letter.. They requested my petition for divorce.. My green card is based on marriage that only lasted two years.. The condition was removed after the divorce.. I sent a copy of the petition for divorce on December 21.. I have not received anything since. Has anyone been asked to provide a certified copy of the petition for divorce before? Please help I am confused.
I cannot thank enough the Law Office of Rajiv S Khanna and my direct contact in this case Anna Baker for doing such a wonderful job in getting me approved for H1B classification within such a short period of time. Anna Baker has been a tremendous help with regard to the case and especially getting back to me on answering my questions at her earliest. Fee is very reasonable for the service I was provided. I would definitely recommend for any immigration issues and I myself look forward to taking care of my future immigration issues with the Law Office of Rajiv S. Khanna.
Anna Baker Great Job. I am very pleased.!!!
Very efficient, helpful and personal services. The process was made easier thanks to the professional staff. Thank You very much. I highly recommend their services.
My labor certification was done without any problem and the guidance I am getting for filing I-140,I-485 for me and my family members is excellent and I shall be grateful to Mr.Khanna and his team
There is no question that there might be a large number of good Attorneys around but Mr. Khanna and his superb team can provide what only a few can. That is honesty, excellent advise, easy accessibility to him and the rest of the team, fast work and over all results. I had experience with few attorneys and I can say without a doubt that he is the one and there is no need to look around. If you are looking for quality here it is.
I think you guys are bunch high quality legal experts on immigration. Thanks for your good works.
The service provided by your firm was excellent. Ms. Homa Naderi in particular was extremely hopeful and responded to my queries within an hour. Mr. Khanna too was easily approachable and provided excellent advise.
I am surprised and at the same time very happy to learn about the immediate processing of my LCA by the SESA (It took just one day to be precise.) I give full credit to Ms. Subha at Law Offices of Rajiv S. Khanna for this as she so carefully prepared my application form that the State labor department had no problems with it.
It has been a great experience working with your firm towards my green card process.
Ok,
I just got back and I wanted to let you all know how it went, cause it felt like such an easy process, that I still can't believe it's over.
Our interview was at 10:00 am at the San Francisco office.
We arrived around 9:50 am (parking difficulties). We ended up parking at the corner of Sansome st., which costed $18. At that point I was so nervous that we were gonna be late, I wouldn't have minded paying $100 for parking.
A real great experience working with Mr. Rajiv Khanna. Very thorough in his approach and explanining his thoughts in an easy to understand, non-overly legal language. Crisp, precise and friendly, his opinion has been valuable in my preparations in acquiring for a US visa.
