FAQ: EB-3 petition downgrade; CSPA protection for 21 year old son I-485 Green Card final interview process/questions asked, etc. Retaining valid H-1B status while AOS is pending and when to file Supplement J
Release Date
WASHINGTON—The U.S. Department of Homeland Security is seeking data and information from the public that DHS intends to use to develop a public charge regulatory proposal. The purpose of public comment is to ensure that the proposal is fair, consistent with law, and informed by relevant data and evidence. Public comment also will help DHS ensure that the proposed regulation does not impose undue burdens on noncitizens seeking admission to or adjustment of status in the United States.
USCIS recently updated the following USCIS form(s):
1) Most attorneys don't recommend to abandon H1B status while AOS is pending.
What are the chances of AOS denial for someone who has had a clean history and is a law abiding alien living in the US waiting for AOS?
2) What are your thoughts about the timing of filing I-485 J? Upon job change, should it be filed proactively or wait for RFE Won't it delay the AOS adjudication if it's not filed proactively?
I do not think you should let your H-1B or even L-1 lapse just because you have a I-485 pending. There are times when things go wrong with the I-485. So it's such an easy thing to maintain your H-1B.
As far as the I-485 J is concerned, I personally feel that the Adjustment Of Status Supplement J should be filed as quickly as possible as it will give you an additional protection. More...

My son turns 21 years in August, and as per the August Visa Bulletin my EB3 Downgrade petition is current. Does this means my sons is covered under the CSPA and eligible for EAD renewals?
There are two dates based upon which green card applications move one date is the date for filing and the other date is the final action dates. Your CSPA protection is covered by the final action dates; the visa bulletin dates when they become current. Dates for his final action dates must become current before he turns 21, if they slide back again, that's not a problem but for one time they must become current. More...

1) Please list out what are the documents need to be carried for final interview by main applicant and the dependents?
2) What are the general questions we can expect from the officer during the interview who makes decision and how the interview process will be, so we can be aware and prepare ourselves?
1. Always tell the truth.
2. It is okay to say I don't know. Also, if you are struggling to reply you can say I don't remember and always ask for a clarification if something is not clear. More...

I hired the services of Mr. Rajiv Khanna's law firm after a so-called big shot immigration attorney here in Dallas proved to me that his incompetence & sheer lack of knowledge came at an exorbitant price. Being a perfectionist by nature, I decided not to go in to the H1 process with that conman and chose to go with Mr Khanna's law firm instead after thorough research. Can easily say that it was one of those decisions for which u pat yourself on the back. The sheer promptness, professionalism and clockwork precision exhibited by Anna Baker, Rena Waddell & Charu Bhagat was exemplary. At the same time, they were very patient with my constant complex queries. I never felt a lack of warmth in my interaction with them, which is pretty uncommon otherwise, especially when it comes to law firms. The processing & paperwork was super-quick and the ball was always rolling. It was hardly any time after my case was filed that I got a call one morning informing me of my approval. And to think that I have never even seen or met any of these wonderful people. One word to describe these guys. Brilliant.
Hi Rajiv, I just wanted to take this opportunity to complement you and your highly skilled team of lawyers on doing such a fantastic job of helping so many people out there who don't have enough understanding of US laws. You guys are not only knowledgeable but also EXTREMELY courteous and willing to help to all of us. I would specifically like to mention Leila M. and Hanna Baker, as the two individuals, I had an opportunity to talk to, and both of them were really helping and understanding. I can't thank them enough for providing the MOST accurate advice which helped me a lot and that too without expecting anything in return which makes it even more noble. Please keep up the good work.
Thanks.
Thanks to Chary Bhagat and Rena Wadell for a job well done. Extremely helpful, diligent and patient!!!
Hope to do many more cases through immigration.com
It took me full 6 years to get through the green card process and had to face a lot of obstacles along way. So what, Rajiv was there at every stage of the process. Thank you for your expertise and support. Thanks to everyone on your staff, especially Suman Bhasin, Leila Leyman, and of course Diane Lomabrdo. Great team!
Each month, the Visa Office subdivides the annual preference and foreign state limitations specified by the INA into monthly allotments based on totals of documentarily qualified immigrant visa applicants reported at consular posts and CIS Offices, grouped by foreign state chargeability, preference category, and priority date.
When should my H-1B petition for an extension be filed?
An H-1B petition for extension may be submitted to USCIS no more than 6 months prior to the expiration of the current H-1B status.
I do not have an I-94 from my last entry to the US in June, but I need it for my H-1B renewal. What should I do?

Finally the day has come for which I have been waiting for a long. I sincerely thanks to Rajiv and his entire team for providing me high level professional services during the entire process. I especially thanks to Amrita and Prernaji for help me so much with all required processes and answering all my queries promptly. Both of them impressed me with their thorough knowledge of process. A big Thank you to the Law Office of Rajiv S. Khanna for all the valuable advice and help they provided with our Green Card processing! We just got the CPO emails yesterday and are waiting for the cards to arrive now. We highly recommend them for any kind of immigration work. Rajiv and his team are great to work with. For specific case informations, we have scheduled direct calls with Rajiv and he has always provided valuable advice at appropriate times.
1. Our employees are deployed at government sites. Are we still obliged to pay the H-1 wage?
2. Can we ask such employees to use their paid leave?
A1. Yes. In my view, that obligation continues unabated.

A registered nurse who is coming to the United States to perform labor in covered health care occupations (other than as a physician) and wishes to apply for Immigrant Visa(Permanent Resident Status) is required to have the following:
It was great working with Rajiv, Anna, and Aneet. They addressed all my queries. We went through all the processes, and every week we were updated about the progress and followed a path. The team is not money-minded, so ensured that everything is submitted in a detailed manner. They explain everything why it is done, so you understand it before putting in the effort and money.
5 stars for promptness, availability, quick response, attention to detail, knowledge, and experience.
