My wife and myself finally got our Green Cards approved few days back. It took us about 3.5years from start to end due to broken immigration system. My O petition was approved through your help and when I went for O1 Stamping my visa was not issued due to Chennai consulate in patent misunderstanding of the law that being subject to INA Section 212(e) home residency requirement.
Finally Mr Khanna sent the a brief explanation that "It is long settled law that 212(e) does NOT apply to O-1 visas" and i got the O1 stamping. I was in a difficult situation with a missing labor certificate, pending I-140 due to that and fighting with DOL, Mr.Khanna's office did an excellent job especially Mr.Jitesh dealt it through every possible opportunity and finally got it resolved by taking it through lawsuit against DOL. This shows that their experience counts while dealing with typical cases and troublesome situations. There has been a great communication through email on every step and effort to get this resolved. I have been using the services of The Law Office of Rajiv Khanna for a while now. Labor certification in my case was recently approved, following conversion to RIR. The window for conducting recruitment and preparing the package was small, only 4 months. In addition, I was away for a month on vacation during this time. However, with my employer's and Vijay's help, I was able to complete the recruitment process on time. Vijay was very patient and professional dealing with my employer and me, despite some delays at my end.
In spite of the fact that my case was closed mistakenly by backlog center, Rajiv Khanna's team were great in communicating with backlog center and was successful to reopen my case. I am very much impressed with the professionalism of Richa Narang, one of Mr Khanna's staffers. She was very patient and worked very hard to complete all the forms and putting the supporting documents together before filing with USCIS. I used the services of Mr Khanna's firm to file for Green Card through labor certification (EB2 Non-RIR) in Oct' 2003. In Jan' 2007 the Department of Labor came back asking us to convert non-RIR to a RIR application. Mr Khanna's firm supported me with documentation, news paper ad details and answers to lots of my queries. The RIR application was mailed on 03/29/2007 and I received a notice from US Department of Labor on 04/26/2007 that my labor has been Certified. I started the whole process in April 2005 with Rajiv Khanna as my attorney. He is an efficient lawyer of great standing and he has done an excellent job at every point in the whole process. i think my experience might help others so i m writing it down.
my husband and i came to toronto canada on sep, 6th 2005 (yes 2 days ago).
we had our interview appointment on sep, 7 9:00 am.
my husband came to US from pakistan in 1999 on a student visa. He did his masters and then got a job in Houston. He is a mechanical enigineer.
we got married in 2002 and got our first H1 stamped from islamabad, pakistan.
The Immigrant Visa looks like a H1B1 visa stamp but the information is obviously different. The embassy also hands out a packet with top right part perforated. It has a white paper on the front which has your picture and information on it.
I landed at Chicago O'Hare airport at about 3:15 PM. While in the plane, I had filled only the customs forms and not the I-94 white form. After landing, I went to the New Immigrant line. The officer looked at the IV and took the packet from me. He sent me to the NSEERS special registration line.
My green card is being processed through Rajiv Khanna's office and I am extremely happy with the services they have provided at various stages. My company was taken over by another company and my company had filed for I-140 amendment for name change. It was approved without any queries.
