I am going to India for my wedding, I plan to do my L1A stamping and get an L2 for my wife. Now suppose my L1A stamping is denied, what happenes to my existing L1b petition which is valid till 2011 Oct? Can I use that to file and L2 for my wife and return back to US?
Your current approval is not invalidated by denial of an L-1A. You can use it.
I have 3 yr Bachelor's degree (BSc) + 3 yr Bacheolor's degree in technology(BTech) from India and 8 years of experience. Do I qualify to apply for Green Card under EB2 category if the position requiers MS or BS+5 yr experience.
Usually, you are NOT permitted to put together two 3-year bach. degrees. So, it appears unlikely you will qualify for EB-2.
I have a GC since Nov 2004 and stayed in US for 3 years before moving to India on a temporary assignment. I have been in India for the past 2.5 years and have got a re-entry permit. When I return to US in April of next year, since it has been more than 5 years since I got GC and I had been physically present in US for over 2.5 years, will I be eligible for applying for citizenship?
Since you have been out of USA for more than one year, you will be eligible for naturalization only after 4 years and 1 day after you come back to live in USA.
SAN JUAN-Puerto Rico Governor Luis G. Fortuño extended last night the validity of birth certificates issued before July 1, 2010 to American citizens born in Puerto Rico for 30 additional days, until October 30, according to Secretary of State, Kenneth D. McClintock.

I was in my fifth year in USA without starting my LC process. Since it was a critical stage for me, I asked my company and Mr. Khanna to file PERM LC for me ASAP. My contact person, Seema, helped me a lot in preparing the case in a speedy manner and also answered all my questions promptly. Its a very good feeling when you work with nice and professional people. Today after three months of filing my case I received a "Congratulations" email from Seema that my LC got approved. Still have a long way to go but sure its a good start.
I am presently in Canada on Canadian PR (and have an indian passport). An employer in Indiana (from a hospitality background) is interested in hiring me.
1. They have no clue abt H1B visa. How do I proceed?
2. I was on J1 from 2000 to 2001. I do not have a waiver. Will this affect my application?
If you have neither complied with the J-1 home residency requirement, nor obtained a waiver, you cannot get an H-1. Make sure you are indeed subject to the 2-year HRR. You may not be - then an H-1 is a possibility. Go here to ask DOS for an advisory opinion: http://travel.state.gov/visa/temp/info/info_1288.html
My mother had an appoinment to get a visa today and she got denied but they did not give her a reason, is there a time period she should wait to try again or can we find out why somehow.
They are required by law to give a reason. Contact your Congressman.
I have been a petitioner for my brother since I offered it in 2002. Now, I don't want to be a sponser for my brother. Can I cancel it or not?
You can withdraw the Form I-130.

WASHINGTON—Under an executive order signed by the Governor of Puerto Rico, certified copies of Puerto Rico birth certificates issued before July 1, 2010, will now be valid through Oct. 30, 2010. The validity of those certificates had previously been set to expire on Sept. 30, 2010.
I appreciate all the insight and the help from Mr. Khanna's office in regards to applying and getting my case approved with in one year. Would specially like to thank Mathew, Bharathi, and Rita to answer my queries.
My wife and I received our ‘welcome notices’ within 1.5 years of the whole process with Rajiv S. Khanna as our attorney. To give you a brief background about our GC journey, my EB1 (OR) was first approved last year. During that process, I received an RFE and Mr. Khanna and his team were very skillful in handling that RFE and got my I140 approved. Later, it was a pain staking journey concerning the I485 and finally I received the email from USCIS indicating that the ‘Welcome Notice’ was mailed and my card production was ordered. During the whole process, Mr. Khanna and Diane Lombardo were very professional and provided me with relevant information concerning all immigration related legal issues, so that I clear the process without any hassle. I strongly feel that Mr. Khanna knows his field and I would recommend his firm to anybody. We are really glad that we chose this Law firm. It’s worth every penny. We are greatly pleased with Mr. Khanna and his staff as far as their professionalism, courtesy and promptness regarding my GC processing.
Happy to see our 485 approved.
Really appreciate the help, guidance provided by all the staff from Law Office of Khanna's in the process.
My wife and me got my green card after 5 years. We are greatly pleased with Rajiv and his staff as far as their professionalism, courtesy and promptness regarding my GC. Some of my friends and employees of our company went through Rajiv and all of them are also happy like me. We are thankful to Rajiv and his staff.
I reserve only the highest praise for Rajiv Khanna and Heather Crump who helped us throughout the immigration process. It is rare to find legal services provided in as friendly and supportive a manner as rendered by Rajiv and Heather. Both Rajiv and Heather gave generously of their time and expertise and answered all our questions promptly, clearly, and completely.
Rajiv's approach is warm and personal, not cold and clinical, and he constantly provided the sort of big-brotherly, yet highly professional, support that put us at ease through every step of our immigration. With Rajiv on our side, we were quite confident of having our family-based green card application approved, even though ours was a somewhat unconventional case.
We were equally lucky to be assigned to Heather whose positive attitude, kind words, and personable nature brightened up many of our days.
Judging from the high quality of legal services we received, it is not surprising that the "Law Offices of Rajiv S. Khanna" are spoken of so highly.
I strongly recommend the "Law Offices of Rajiv Khanna" to my friends and family for expert legal help! You will be in good hands!
We received our green cards yesterday and would like to thank the team at Rajiv Khanna's Law firm. Prerna and Richa were awesome and answered every query quickly and efficiently. I highly recommend this firm and both Prerna and Richa. Thanks again!
I had my Interview today and it went great.
I arrived there at 8.15 AM and my appointment wasn't until 8.40 AM so while I was waiting one of the security officers there tried to calm some of our nerves .....
At exactly 8.40 AM my Name was called, I walked into a area where she stopped me real quick, greeted me and ask me for any kind of ID so it is really me.

I got to the Seattle office at 7:00a got done with security had a nice chat with the security officers about the thx giving break and then headed up to the second floor to wait to be called. There were quite a few people in the waiting room at 7:30a. Around 7:40a the immigration officers started calling people for their interviews. I was called in at 8:10a and was greeted by the interview officer.
Dear ones,
I just had the most happiest International Women's Day yesterday
First of all, I want to thank all of you guys. This forum has been really helpful in understanding and providing information on the interview procedures and papers to take and everything. Thanks ari4u, especially. You are a keystone in this forum!!
Hello,
I had my Interview yesterday in Northern Virginia. The appointment was at 1:00 PM, we arrived at abt 12:30. We were called in at our scheduled time. The officer was cordial. He asked the usual questions, like if I have ever been arrested etc..., He went through the affidavit of support, had questions for my husband regarding his employment letter, checked our passports, asked us both questions about each other, i.e our In-Laws Names, How we met, when we got married, how many guests, What cars we own, date of births, my employer details etc...
I went for my interview, which went well. No surprises with a nice officer.
The common, have you ever questions...no no no no!
We were asked about the spouse's siblings, our honeymoon, when and how we met, how long we'd been dating before marriage, but nothing tricky.
Quite easy I would say.
The officer checked Id's, last taxreturn with W-2s, updated address (because we moved), marriage cert.
Hi all, Finally I have got my GC approved. Just yesterday I recieved my card in mail. I am so happy and relieved because it has come in just the right time. Many thanks to everyone at immigration.com. These people are very professional. Specially I would like to thank Prerna, Vijay and Mathew for helping me out throgh out my GC process. I would highly recommend Immigration Law firm to anyone looking for representation in immigration matters. Best thing about them is you can actually talk to the lawyer or your assigned contact person yourself which unlike other law firms is almost impossible.. Great job guys..You are really the best.
