I really appreciate the diligent work that you and your team put into my case.
The fact that we didn't get any RFEs for my I-140 and I-485 petitions, in spite of having my previous I-140 petition and the MTR denied by USCIS, shows clearly that you know the way to present material to USCIS so that it doesn't leave any questions/doubts in their minds that we qualify to stay in this country. I believe this is the result of your analysis of each case meticulously and preparing the supporting documentation according to the nature of the case, rather than following a cookie cutter formula like lot of other attorneys. I have seen my previous attorney do it and lot of friends' attorneys doing this. The standard statements I have heard so many times... "We don't need to submit that document now. We can submit that if USCIS asks for it". Forget about sending the documents to USCIS, they don't even let us know that we may need a piece of document and ask us to have it ready. Everything seems to be reactive, rather than proactive. No wonder USCIS takes so long to process some applications. They have to ask for every piece of information and at some point, they might even deny the petition for lack of clear evidence.
For all people who are going through the long and painful process of getting GC, there is only one advise I would like to give. Try to have a highly experienced immigration attorney like Rajiv on your side from day one. It is really hard to correct the mistakes done by other attorneys later. A petition filed with all the necessary paperwork, in the correct form and order will save you from a lot of heartache later on. Even if your company doesn't reimburse for the expenses, it's worth paying for it from your pocket.
And Rajiv, I would like to make a small suggestion to your staff too. While both my I-140 petition (re-filing) and H-1B extension petitions were being processed at the same time (during Dec 05 - Jan 06 timeframe), when your staff asked for copies of the same documents multiple times, it was getting on my employers nerves. The rant I kept on hearing from my company's HR people was, 'we just mailed/faxed them that document last week. Why are they asking for another copy again?'. Members of different teams didn't seem to have any idea that another petition is being handled by a person in the same office and that those documents already exist in another folder in the same office. A few small notes tagged to the files or consolidation of documents for each client might make the experience even more pleasant.
Thank you so much for your help and attention. I wouldn't even think of going to any other attorney for any future immigration related work I might have.

Excellent job by Rajiv and co! First I got my I-140 approval within 2 weeks and now I've got my Green card within 9 months of concurrent filing of I-140 and I-486. Thanks to Rajiv and the whole team for their wonderful help. I got my I-140 approval in 15 working days. Wonderful job done by Aruna and Mathew. They are very good in coordinating with employer, clarifying GC related questions during the process.

I got married last month ! My husband is a GC holder and next year is going to become Citizen , I have my GC (I-140- Approved) with a priority date of September 2019 on EB3 . What are my best options here ? Do I wait for him to become a citizen and then apply for my GC through his citizenship ? Or shall I apply GC now through his GC status, before he becomes a citizen ? Or shall I wait for mine ? Will my pending GC still be valid if I apply through my spouse ?
You should apply through as many green card categories as are available to you. The family-based green card can be upgraded once he becomes a US citizen. You will be able to get and keep the green card through whichever category comes through first.

FAQ: Working for two employers on W-2 using the GC-EAD || STEM extension denied based on approved H-1B pending for withdrawal at a USCIS service center || Correcting names on passports, visas, and other documents || Options to remain in status: F-1 visa expired, H-1B approved for consular processing, but not stamped.
I am in a situation where my current employer has filed PERM and as per the timelines there are high chances that it will be approved till January. And as per immigration team in the current company says it could take a week or two to file for I-140. I am going to pay for premium processing. But at the same time, I have accepted an offer from another company and the start date is 31st January. I am sure that I-140 would not get approved till then. Can I pay for premium processing, leave after they file the I-140 and before it gets approved? Will it go through?
PS: As per company's policies they don't revoke I-140 of the employees if they leave before 6 months.
Theoretically, an I-140 does not require you to be continued to be employed by the petitioning employer. You could leave after applying, but if there is an RFE, the employer would not be motivated to respond to it. As a practical matter, there is a second difficulty as well.

I am on my H-1B and my wife is currently on her H-4. With the new bill does she still need to wait for my I-140 to be approved?
There is no new bill, just a policy clarification. And, yes, she will have to wait per the law.

My wife & kids H4 was not renewed and were Out of Status due to company's fault and my ignorance and trust on the company. This happened in 2003. We hired a local lawyer, best in town, to handle my case in 2005, when I found out on my own that my dependant's H4 was not renewed. We applied at USCIS, but was rejected. We appealed in the Court, but was denied.
I contacted Rajiv Khanna and we applied in 2008, after more than 4 years in Out of Status. My H1 was renewed, along with H4 in 2 days!!!!! Can you believe it?
After 4 years of Mental tension and all the agony, we passed through, we felt so relieved.
We got our new I-94s attached for my wife and 2 kids. Great People, Nice Dedicated Staff, Intelligent Lawyers.
I would recommend him to anyone, no matter how big or small the case is, Do NOT look any further. I did all my research for all these years looking for good lawyer, don't spend any more time searching. If you are in trouble, take my advice, talk to him and he can definitely help you. Both me and my wife filed for our I-485 processing through LORK in July 2007. My file got through and I received my EAD,I-485 receipts and AP. But my wife's file got lost in USCIS and we did not got any receipts. Roopa and Matthew put in great efforts to get her application through. We really appreciate the work done by entire Rajiv's team.
