My H-1B visa is going to expire in 01-Jan-2018 and if my employer submits my PERM application in the month of June (i.e. before 6 months of my current 6 years of H-1B visa duration).
1) If my PERM gets approved before my current H-1B visa expires (i.e. before 01-Jan-2018).
Would I be eligible for a H1B extension for 1 year since my PERM was approved before the current H-1B expiration?
2) If my PERM gets approved after my current H-1B expires can my employer file for H1B extension of 1 year since my PERM is approved now.
3) If my PERM is not approved before my current H-1B visa expires.
Would I need to go back to India?
4) I spent about 2 months (on vacation) in India. Can these 2 months be added back to my current H-1B visa? or this can only be added if my current employer files for my green card?

I am a permanent resident, a citizen of Poland. I want to study medicine in Poland. The program lasts 6 years. I don't want to abandon my status and want to understand if such long-term abroad is possible. If I am not mistaken GC holder can be away 6month-1 year. But, since I'll be out of US on regular basis, so it's best to apply for a reentry permit?

I am in I-485 pending status based on EB2 and have been working on EAD since 2012. Under the new rules effective January 2017, I understand that I can file for EAD extension 180 days prior to expiration. Will EAD be considered extended automatically if the approval doesn't come before the expiration of my current EAD?

I am a US citizen and would like to sponsor my brother for Permanent Residency. How long would it take for him to get Green card.If I file green card for him, does his family (His wife and kids) automatically get green card or should I file for each of them? I think I should for all. Just a question? He gets a EAD (so he can start working) when I file Green Card?

Mr. Rajiv Khanna, Mr. Kunal Sharma and the rest of the team have been very patient and extremely supportive.
I had filed for my immigrant visa through my spouse, and it was quite complicated. Couple of the other lawyers we spoke to said that there are no chances in winning this case, but Mr Khanna was firm, that the fundamentals are right and thus we have a good chance. Finally, after 2 long years, my immigrant visa has been approved.
What impressed me the most is the Mr. Khanna would immediately schedule an appointment (no charge, of course) every time there was some news from the immigration office or from my side. Even during the final stages, I had asked him a few questions regarding my DS-260 as i was very nervous, he scheduled an appointment immediately and told me exactly what to answer in each question. They made me feel as if I was their only customer. Excellent effort and care for each case by the team, and I would surely refer his firm to everyone.
USCIS has published an updated Welcome to the United States: A Guide for New Immigrants. The guide contains practical information to help new immigrants settle into everyday life in the United States, including how to find a place to live, how to get a Social Security number and how the U.S. system of government works.
My H-4 to F-1 is approved on October 08 2015. My Spouse Employer filed H-4 extension for me which is currently in Process. We sent this H-4 withdraw letter and it has been reached USCIS (Vermont Service Center) on Oct 13th 2015. Could you please let us know approx when do USCIS withdraw this H-4 extension?. If by mistake USCIS approves this H-4 Extension, can we fight with USCIS to withdraw this H-4 extension?

The forms for the H-2B program have been extended temporarily until November 30, 2015 while OFLC awaits approval of its request for a three year extension under review with the Office of Management and Budget (OMB). OFLC will continue to extend the forms in one month increments until approved by OMB. A second comment period, as required by the Paperwork Reduction Act, ends November 30, 2015.
USCIS recently published an update to the following form:
I am on H-1B visa and in green card process (waiting for I-485 date to become current). I would like to know if I buy and rent houses on my own name (without forming an LLC) and actively manage the activities (finding a renter, maintenance etc) and make profit out of those rentals, then would it violate my status?

1) Is there any difference between I-140 revoked by employer - vs - I-140 revoked by USCIS (say for fraud or misrepresentation) with respect to being able to retain the priority date with the new employer ?
2) Changing from Employer A to Employer B - If Employer B files the PERM before I-140 by employer A is revoked by the employer A - would that help retain the PD corresponding I-140 to employer A ? In other words, are there any specific scenarios in this case - where the PD could be retained based on the first I-140 approval ?

I am currently pending I-485 (EB3, skilled worker employment based, priority date Oct 2008) since April 2014. I submitted inquiries through congressman, they received a letter that my case is on hold indefinitely. Do you recommend filing Writ of Mandamus or would that cause a denial? What other actions can I take, I've submitted a case through the Ombudsman and met with a USCIS officer through Infopass appointment (who told me nothing). No RFEs have been issued for this case, I-140 was approved and fingerprinting done (twice, since first set expired).

Thanks to Rajiv and Heather for successful approval of my I-140 approval. Journey started with some questions as student visa holder where Rajiv answered all of my questions with full patients and at the end of call he Refunded my fees bcoz he doesn't charge any fees to students. Next was H1b process where my chance of approval was very slim and the company was at its starting phase. Having no options on table we took a chance, with Rajiv's skills and tremendous experience he made the case that no one can deny it and we got it approved. Same thing with I140 stage where also chance of approval were very slim due to change in conditions of business, he offered me to abandon the case in middle and save his fees which I think no one in his profession would do that. Then we decided to put some faith in god and Rajiv' S expertise as we already knew he can make the case with any situations. and here we go I140 approved.............Hoorey.............he did it. Thank you you are the best ...
