I've just started my GC process with Mr. Khanna's firm. They are about to send my DOL LCert. While working with them since last few weeks, I admire there professionalism and dedication. In June of 1998 I changed jobs, and moved here to Florida in July of 1998. I began filing for new H1 visas in May of that same year. It took Just under two(2) months to get our H1-B and H-4. Just recently (Dec. 1999) our application for Alien Employment Certification, through the Atlanta DOL was approved. We are now in the process of filing our I-140 and, once the priority date becomes current, the I-485 (adjustment of status for GC). My wife and I are extremely pleased with the results Mr Khanna has been able to achieve since we first started with him in Maryland. We have come a far way, and it is refreshing to know that changing lawyers was the best choice we have made throughout this ordeal. I have read some very nice articles on your Forum and wanted to get your help on My Weird Issue with I94.
I am on H1-B Visa and my Approval (I797) is Valid Till October-2010 However My Indian Passport is Expiring on 26'th-Aug-2009. I just came back from India a week back and Immigration Officer has Issued me I94 Till my Passport Expiry.. Is thr any other way for me to Apply for I94 Extension based on Approval validity without Leaving the Country ??? or i have to leave the Country & Come back ???

Whenever CBP gives you an I-94 with mistakes on it, they can easily correct it if you just go back to the airport and request a correction. Most airports have CBP office hours. In my view, they should issue an I-94 co-extensive with your approval, not your passport. So, go back to CBP. Post your experience here for all.

My wife currently working on H4 EAD which is valid till October 2020. Her company filed for H1B this year and she got approval for 3 years starting 10/01/2019.
However, She would like to stay on H4 EAD. Does law permits her to work on H4EAD even after her H1B approved? or naturally her work visa status will convert to H1B effecting 10/01/2019?
