My parents have been here on visitor's visas since the beginning of August. If they are here for the entire six months, can they come back again within six months of leaving the U.S.?
The CBP (Customs and Border Protection) may find this pattern an unacceptable use of the visitor's visa. Generalizing for the sake of making a point, if in any twelve months your parents have spent more than six months in the United States, the CBP can hold that it appears your parents are living in the United States and visiting their home country instead of the other way around. Q: 1.Can I run my second W2 on my own company? Keeping my primary W2 with the same employer who filed the GC?
2.If I start a business on GC-EAD, if they call for a GC interview what type of question do they ask related to business?
3.If I-485 is denied, can we come back to H-1B again and do we have to refile I-485 again?

Was just wondering if there could be any issues with my prospective PERM application if I am living and working remotely in Minneapolis (consistent with my H-1Blocation) and my employer in Dallas files the PERM application using Dallas as the work location. I am open to eventually relocating to Dallas, so just wondering if this could cause any delays or RFEs for the PERM. Do you think it would be a better option to file an H-1B amendment with Dallas as the work location, and then go through with the PERM or it doesn't matter?
It is not a problem as long as these two scenarios are followed. First of all you could be working in location X and the PERM is filed for location Y as long as you have the intention to join the location Y you can file even though you are currently working at location X.
The interesting thing is once the I-485 is filed and the I-140 is approved after 180 days of the I-485 you can choose to be wherever you want to be because you are allowed to port your green card. The only requirement is when you start the PERM. File the I-140 and the I- 485. Your intention throughout was to work at location Y but after 180 days if the intention changes it is absolutely no problem.
The second scenario which is very common is when you have consulting jobs and you could be moving from a month to a year with no predictability where you are going to be, it is normally recommended and legally allowed to file the PERM application as though your job is located in the corporate headquarters or principal place of business. Q: 1. If the Priority date is current in EB-3 then my I-140 and I-485 can be filed EB3 (Lower it) but you said that after EB-3 will come then I should file I-140 in EB-2. Not sure about the whole concept, if possible can you elaborate in more detail?
2. Can I-140 be filed in EB-2 and EB-3 together? Or I-140 can be filed in EB-3 first once it gets approval in EB-3 and then need to file in EB-2 or vice versa.
3. My company attorney told me that once I downgrade to EB3 then I can't upgrade to EB2.
A: 1. You can always downgrade if you start your case in a higher category, but if you file your case in the lower category it's not possible to upgrade without refiling.
2. The answer is yes, although I like to do it separately for several reasons, most of all to avoid confusion, but now the government is well aware of these downgrades and I think you could file both of them together as two separate filings.
3. They must be saying something different as that is not true. If your PERM was filed as an EB-2 and I-140 was approved as an EB-3 you can always go back to EB-2 by filing another I-140 under EB-2. More...

Dear ones,
I just had the most happiest International Women's Day yesterday
First of all, I want to thank all of you guys. This forum has been really helpful in understanding and providing information on the interview procedures and papers to take and everything. Thanks ari4u, especially. You are a keystone in this forum!!
Hello,
I had my Interview yesterday in Northern Virginia. The appointment was at 1:00 PM, we arrived at abt 12:30. We were called in at our scheduled time. The officer was cordial. He asked the usual questions, like if I have ever been arrested etc..., He went through the affidavit of support, had questions for my husband regarding his employment letter, checked our passports, asked us both questions about each other, i.e our In-Laws Names, How we met, when we got married, how many guests, What cars we own, date of births, my employer details etc...
I went for my interview, which went well. No surprises with a nice officer.
The common, have you ever questions...no no no no!
We were asked about the spouse's siblings, our honeymoon, when and how we met, how long we'd been dating before marriage, but nothing tricky.
Quite easy I would say.
The officer checked Id's, last taxreturn with W-2s, updated address (because we moved), marriage cert.
I am a USC applying green card for my wife who has been a full-time student for 5 years. We had our AOS interview at Portland, Oregon today (April 20, 2006.)
Our interview was scheduled at 2:00pm and we arrived at the waiting room around 1:20pm. We got called by a very nice officer around 2:05pm and was out of the building around 2:32pm.
I got my wife's I-94 corrected (it had expired for 10 days) by going to the EWR airport office
which was my wife's port of entry.
They had also put an incorrect classification of WT on the I94
instead of an H4 and as such corrected it promptly.
I want to thank your law firm and also Mr. Khanna in particular
for his proper guidance to me in this delicate and urgent matter.
Thanks to Richa and Mohana, for your timely and well organised support, I got my PERM Labor Approved within 10 Days!!
I have a lot of experience with the immigration lawyers. This time with Rajiv's office is a WAY different (better) experience:
* immaculate filing preparation - this is not some sloppy paralegal preparing your docs with bunch of misspellings and inaccuracies;
* excellent communication - forget your voice-mails with no responses or the your attorney's email black-hole. Rajiv's teams are fast in response and their answers are clear and focused on what you need to know.
* deadline oriented - with Rajiv S. Khanna's office you KNOW the answer of all your when, where, why and hows....If they commit to date - that is your filing date. You never get nonsense excuses.
* respect - all we know that immigration process is not straigth forward and trivial process. Some times things can get bumpy and you may loose your patience. At this time you need moral support and respect no less then a legal help. Rajiv's team is there for you - your best friend and guide. Actually you become at some point member of the team.
* professional awareness - here I'm going to say just one thing and if you read this you'll understand what I'm talking about. This is the first attorney company that I'm working with and I DO NOT have the feeling that I'm more up to date with the immigration law changes and updates then my attorney.
I know at a time I sound like commercial ad, so let me put some names to my words.
My awes goes to the Mathew and Aruna team. Thank you for the excellent job done so far.
And here is my time-line:
PERM: FD: 8/11/2005 AD: 9/12/2005
EAD AD 10/4/2006
AP AD 10/4/2006
I140 AD 8/5/2006
I485 .. soon...
Khanna and his colleagues (Richa,Mohana) did a great job in getting my labor certifed with in 8 days,I like their personal interest in going through the documents very keenly to cover up pit holes, sending the drafts timely at each stage, followup and more over very honest in giving status about whatz going on with the case.
I can recommend anyone to blindly go ahead and trust this people.i feel blessed by knowing these folks and working with them.YOU WILL HAVE A PEACE OF MIND WORKING WITH THEM.
Thank you everyone in Mr.Khanna’s firm.
Law offices Of Rajiv S Khanna provides high quality professional services. They are very organized and have immense knowledge and experience to deal with immigration cases.
I would highly recommend them simply because they work as a well co-ordinated team to deliver services.
Special Thanks to Suman Bhasin, Richa Narang and Mohana Navran for their timely help, mammoth efforts and valuable legal advise.
Excellent quality service. Immediate e-mails response. Paperwork prepared very well. Mr Khanna is very knowledgeable attorney. Very good representation.
My sincere thanks to Rajiv Khanna and Amrita for their efforts in getting my PERM approved in a remarkable time frame.
My case was a bit complicated. Initially my PERM application got rejected three times over a four week period. The DOL was being quite vague about the reason stating that the alien does not qualify for the job.
However Mr. Khanna's expertise in this matter and dedication of Amrita got my application through, in the fourth attempt,
in a matter of three business days.
Mr.Khanna is very patient and helpful when it comes to dealing with employers. He spoke with my employer several times throughout the process, answered all the
queries that my employer had and helped him understand the perm process.
I really feel that Amrita put her heart in to my case. Amrita was extremely good about acting promptly on the rejection letters
from DOL. My Advertisements were expiring in 3 days from the day the fourth attempt was made. If she hadn't acted quickly i
probably wouldn't have had a chance.
I personally feel that Mr. Khanna's Law office pays close attention to details. They
are also very good about responding promptly to emails, phone calls and clarifying the smallest doubt you may have.
I strongly recommend their services.
Mr. Khanna is very knowledgeable. They are very prompt in replying to all the queries both from the clients and the USCIS. Mr. Khanna and his team knows how to put the application together and, if necessary, how to answer the queries and RFE's from USCIS. I am very satisfied and would recommend them for anyone's immigration/non-immigration related applications to USCIS. They are a fine group of immigration lawyers.
Mr Khanna's amazing knowledge in immigration law helped my wife to get her H4 visa.
My PERM EB2 petition got approved on May 3rd. The amount of attention given to each little detail in the process and their professionalism had given me the confidence that the labor petition would go thru without any snag.
My sincere thanks to Mr. Rajiv Khanna, and especially to Ms. Reecha Nareng and Ms. Mohana Navran. I appreciate your help and hard work you have put in on my application. You were always prompt and responsive and very helpful.
Thanks
Bhagya
I would like to thank Amrita, Seema for the effort they put in to get my labor approved in 5 working days. Great work!!!
I worked with Ms.Richa and Ms.Mohana. Mr. Rajiv is my attorney.
They have done an incredible job of completing my PERM in time which once I thought would be nearly impossible. We started our process very late in my 5th year.
I am highly impressed with their patience and prompt replies. I highly appreciate them. I found both of them easy to work with. They went thru the documents over and over, and prepared very convincing case.
THANK YOU VERY MUCH TO EVERYONE.
Thanks
Arul

We are very thankful for Rajiv Khanna and team for handling my tough H1B renewal case. This was my 4th Extension that was denied before we approached Mr. Khanna to take over the case. Ms. Kalpana Panuganti was very thorough with case details and responded to any of our queries promptly. We were updated on our case in a very transparent manner and Kalpana always responded to emails/calls immediately while working on RFE response. Their insight and attention to detail in regards to our case was commendable. We would highly recommend Law Office of Rajiv S. Khanna PC for any immigration related matter.
