The Department of State’s Visa Bulletin for August 2016 reflects a final action date of January 1, 2010*, for EB-4 visas for special immigrants from India.
If my visa is in an expired passport, what should I do?
If your Visa is in a passport that has expired or will expire within 6 months of the end of your U.S. visit, you will need to get a new passport. However, you do not need to apply for a new visa. Just bring both your NEW and passport with the valid visa to present to the CBP Officer when you arrive in the U.S.
*Note: Your ESTA is not a U.S. Visa. If you obtain a new passport, you are required to apply for a brand new ESTA. To re-apply visit esta.cbp.dhs.gov.

Bottomline: BALCA appeals take approximately 3.5 to 4 years from the date the appeal is filed.
- Appeals from PERM denials with BALCA office are currently taking about 3.5 - 4 years from date of docket
- Dockets are being completed within the same month that they are received
Just wanted to let people know that it IS possible to get the I-129f processed in an expedited basis.
I am from India and holding an Indian passport. I work for a IT company. I manage around 250 members.
One of the agencies are tied up with another EB-1 and EB-2 processing agency in USA and informed me that they can help in processing EB1-A visa (Self Petition).<br>
My questions are:<br>
1. Is there a category of Visa as EB1-A?<br>
2. If so, is there a possibility for self - petition? i.e. without an employer?<br>
3. If I file EB1-A, what is the waiting period? Approximate is adequate.<br>
4. Once I get the EB1-A visa, can I self apply for Green card or should there be an employer assisting to file for Green card?<br>

My wife's EAD expired last month and she stopped working till today. She applied renewal in December, 2003. We waited till 90 days is complete and went to local USCIS office on 3/22/2003. It is a walk in. The lady in reception verified the I-765 receipt. After making sure that 90 days have lapsed. She asked us to fill some paper work and wait in the adjoining hall. The office called her and collected her Driver's License and expired EAD. After verification he returned Driver's License and asked her to get her picture taken in the next room.
I would like to provide my personal experience at the Columbus, Ohio office. It was a frustrating experience like any other government office experience.We went there at 7.45 AM. We submitted the application forms and the EAD renewal notices, which the security submitted inside to the USCIS (BCIS ) officers. We were walk-in applicants for interim EADs. It seems that the Columbus office prioritizes "all" the people who have prior appointments before the walk-ins. Therefore, our turn did not come until 12-12.30 PM.
The services provided by Mr. Rajiv & Ms. Suman were outstanding and the timely help during emergencies were really professional and courteous.

Applied for EAD in first week of Jan (paper filing) and because of some issue with I got the application back on 26th sent again on 27th received by NSC on 28.. I got the receipt with the RD of 28 and ND of 30th ... My current EAD was expiring on Mar 12. I was waiting and checking the status every day, but when it did not got approved till like 2nd or 3rd march. I started talking with my attorney; I also talked with Rajiv and my company's attorney.

Green card experience : I would like to thank Mr Rajiv Khanna, Fidelina and their staff for all the help they provided through my Green card process. I am glad I selected them as my lawyers and would recommend others too if they want a hasle free green card processing. My Labour was done in Feb 98 and it came in under 6 months. We tried for EB2 I140 but since I did not have masters, we got an RFE. We selected EB3 as an option then but due to some confusion at the VSC side, my I140 was denied, they thought we are asking for EB2 again. My date had luckily become current at that time. Due to the quick response from Fedilina, my 140 was approved in about a week or so. That was something really extraordinary and I am glad Fidelina was handling my case. We are able to file 485 at that time, Aug 99. Got the EAD in about 3 months. But unfortunately, the dates went back. At that time, my wife’s 140 got approved in EB2 and through another lawyer. Her date was current. We were in a dilemma whether to file another 485 while earlier 485 was still pending, do CP or just wait. We finally decided to go for CP. We had our interview on 25 October at Delhi and had to wait for 2 weeks at delhi because of Name check problem. Fidelina had been nice to answer my queries every now and then through the whole process. The CP process was very smooth without any problems. Rajiv's staff is well informed, prompt and very friendly. I had no problem during all the phases of processing. I received prompt response to my emails and Rajiv or his staff members were easily available to answer any questions. My wife and I visited the Hartford office on 4th March 2004 to get an Interim EAD issued. We filed for an extension on November12 th 2003 and as of the visit date it was still not approved.
Total processing time was about 3 hours. Interim EAD was issued for 2 months.
Went to Newark for Interim EAD recently and got in line early at 6am. Got into office at 8am went to 2nd floor, and then got the iEAD appl. With i765 receipt was soon sent to 13th floor ( room #1300 )here they check your papers, i485 receipt, i-140 etc... ( basis for EAD )then sent to room# 1304 here your photo & FP will be done got the iEAD card around 10.30am

7:35 They let us in and gave a slip. Slip was basically asking to go to 2nd floor Romm # 200.

I was getting RFEs in all the last 3 times when my H1B petition was filed, but this time, it got approved straight without an RFE in just 10 days of time with premium processing.
