My interim EAD experience

Hi,

I want to share my interim EAD experience. I went to the local office on July 6 in Arlington,VA.

Well, I arrived at INS @ 7:15AM. There were like 250 to 300 people before me. By the time I got my EAD card it was 4:30PM. There is only one person that was helping issues related to work permits. Part of the reason for the delay was they closed early on july 2.

Anyways, be prepared to take day off (for those who are already occupied during the day) when you plan to go for your interim EAD.

Thanks to Rajiv and his team. My LC was filed in Nov' 99 and got approved on Nov'12th 2000. Applying for I-140. This team is very prompt, patient, energetic and knowledgeable. The team reply to every question very carefully. Rajiv even replied to some personal immigration questions when I need to change my wife's H4 status to F1 (we went to Mexico for this). I thought that i might have to go back to India permanently because labor process is taking 12-18 months.Also i filed my greencard after 4 years of my workpermit (H1B).Awesome work by Mr. Khanna, seema & his team .Rajiv Khanna's office handled my case professionally even at this time of recession.

Had our EADs done in a day too.My wife had a job offer confirmed but did not have an EAD on the day she received her offer letter.Since we had passed the wait period to qualify for an interim EAD we went on a expedition to the BCIS office at 5am and were among the 20's in the line.Got it done in less than a hour and drove to the nearby office for Photo.Had to wait for the office to open the counters and were one among the first few to get it done.Everything was done by 10.30am and my wife got her job too

Green card experience : I would like to thank Mr Rajiv Khanna, Fidelina and their staff for all the help they provided through my Green card process. I am glad I selected them as my lawyers and would recommend others too if they want a hasle free green card processing. My Labour was done in Feb 98 and it came in under 6 months. We tried for EB2 I140 but since I did not have masters, we got an RFE. We selected EB3 as an option then but due to some confusion at the VSC side, my I140 was denied, they thought we are asking for EB2 again. My date had luckily become current at that time. Due to the quick response from Fedilina, my 140 was approved in about a week or so. That was something really extraordinary and I am glad Fidelina was handling my case. We are able to file 485 at that time, Aug 99. Got the EAD in about 3 months. But unfortunately, the dates went back. At that time, my wife’s 140 got approved in EB2 and through another lawyer. Her date was current. We were in a dilemma whether to file another 485 while earlier 485 was still pending, do CP or just wait. We finally decided to go for CP. We had our interview on 25 October at Delhi and had to wait for 2 weeks at delhi because of Name check problem. Fidelina had been nice to answer my queries every now and then through the whole process. The CP process was very smooth without any problems. Made an appointment with Tampa USCIS

I applied for an EAD in April 2004 along with an I-485 etc. The EAD was applied for through e-file.

I heard nothing for 90 days, then made an appointment with Tampa USCIS.

I arrived and was told that as I e-filed the EAD application before I received my I-485 notice of action (but after I sent the I-485 pack) that my EAD COULD be denied. I was told that they couldn't issue an interim EAD and that I'd need to apply again. She then laughed at me and I was asked to leave for no reason.

Rajiv's staff is well informed, prompt and very friendly. I had no problem during all the phases of processing. I received prompt response to my emails and Rajiv or his staff members were easily available to answer any questions. Further he has a real good system to organize and store documents; because of which I never had to refer to any of my old documents over the course of my 3.5 years of Green card processing. Further his consultation fees are reasonable. I would recommend his services.

US immigration benefits require that we present proof that the apllicants have been immunized against certain communicable diseases.  Exemptions/waivers are available for pregnant women and people who have moral/religious convictions that prohibit getting immunized.  The immunization checks are performed as a part of the medical examinations during the green card process.

1. Got in line at 4:15AM. 8 people in front of me.
2. At 7:30AM, they started taking folks with appointments.
3. At 8:00AM, they started taking walk-ins.
4. After security check, sent to the 3rd floor.
5. Told that computers for the ticket system are down, only I90 applicants can be processed.
6. Started giving out numbers manually. Mine was E0002. I176 receipt was taken.
7. Was sent to the EAD section across the big room.
8. Asked to fill I765 application. I brought one from home.

Folks,

We filed H1B/H4 and Green Card application through Rajiv's Office.

His team: Anna Baker, Richa Narang, Prerna Mehta, and Attorney Mathew were very helpful and diligent. They would answer our queries promptly. Multiple I-140 filings

Hi Rajiv,
Thanks in advance. I have an question and keeping me up during nights.
I am working on H1 with comp A, who has filed for my I-140 in Feb-08.
And I also have an Approved I-140 ( Jul'07), have filed for I-485 and also have EAD from company B. I have never used my EAD from comp B, nor have I worked for comp B.
Could there be any issues, which I should be prepared for? As I know it is legal to file for more than one I-140.

As to possible issues, I can probably write a book. Generally speaking, you can have as many I-140's as you like as long each is motivated by a genuine desire to accept a job before or upon approval of the green card. As to your specific situation, consult your lawyers if they feel there is any problem. I hope this helps you sleep better.

I have just been accepted into a residency program here at a university. I am currently working in the same department as a clinical research associate on H1B since april 2006, they have applied for my permanent residency in EB-2 for the same position and I am on 7th year H1B valid till nov 2009. My I-140 is in process and I have responded to RFE on oct 16th and have not got any reply so far. Priority date is oct 2007. The residency starts in july

I think I can continue on H1B till my I-140 is pending and since my green card process is in the same department they have assured me that they will not withdraw my I-140 and that I’ll come back and work in the position of research associate after my residency(4years). Please let me know if this is legally possible as they have the intent to hire and I have the intent to join them when green card is approved.

Ans. Yes. As long as the employer has the intention of keeping the job open for you and you have the intention to join them, the green card process can continue.

Employers and Employees -- H-1 or EAD?

Considering that the economy is not doing that good and sometimes projects get over and consultants go on "bench" without any clients kinda situation, this is something not that uncommon. Related to this, as being on a H1B requires me to maintain the LCA salary as mentioned on my W2, would switching to EAD with my sponsoring employer help with getting away from this restriction?

Does that also mean that if I don't get paid by my employer for a certain period and I am on an EAD, there is no issue with my GC/status at all as there is no H1B.

Just trying to find out what the possible advantages would be at this time with EAD.

 There are two situations to analyze here: being benched and getting paid a lower salary. Both of them have problematic implications for employers and employees.

Here is what concerns me. As far as I know, it has never been done so far, but the possible consequences of being benched are that the I-485 can be denied and (POSSIBLY, but there are strong arguments against it) I-140 could be revoked if already approved. If I-140 is not approved, USCIS could easily deny the I-140.

AC21 Portability - Changing Jobs After 180 Days

What is AC21 Portability?
In the context of AOS (I-485), this is that provision of law which permits an employment-based AOS applicant whose I-485 has been pending for more than 180 days and whose I-140 has been approved to change jobs anywhere in USA to same or similar job describe in their green card application.
There is a lot to discuss, but I am focusing the answers to the questions I most frequently encounter. I will continually edit this blog note with additional information as we go long.
