Our Interim EAD experience
I filed the application form for EAD with the help of our lawyer in the Atlanta office on January 8, 2004. Two months later we got the Notice of Action from Missouri office with two dates - Received Date: January 8, 2004 and Notice Date: March 8, 2004, which was a little bit confusing.
New EAD valid for 3 months
My EAD renewal (at VSC) had been pending for more than 110 days, so I decided to go to the CIS office in Bloomington, MN to get an interim EAD.On Jan 22, 04 the temperature was -10F with the windchill of -30F. I arrived at the CIS office at 7.25 AM. The office was already open. Inside, there were already 50 or so people in the line. The security officer gave me a ticket. After waiting in the line for an hour, I finally reached the security gate and went to the waiting room. It was 8.40 AM.

I got my Interim EAD card based on OPT.
I went to the Bloomington USCIS office (MN) around 4:20 am on Jan 7, 2004. As the weather was cold there were not many people. Somebody made a list and I was the fiteenth person.
Around 6 a.m, we made a line based on the list.
The office opened at 6:30 am.
The officer there started work at 7am. She asked me the reason why I was there and gave me a ticket. I got a ticket and went to another office.

Philadelphia district office EAD Interview
Philadelphia district office EAD Interview scheduled 2.5 months after filing the marriage-based I485 package. People visiting for appointments need not wait in the line. The interview process is only taking a photo, leaving the finger print. the EAD card was printed out right away. The whole process took about 20 minutes, excluding waiting time in the waiting room.

I went at 10.15 am with I-140,I-765 and I-485 receipt, they gave me a token and new I-765 application to be filled up and called me at 2.15 pm. They checked the above documents, Passport and took my photo and gave me EAD instantly.There is no need to take separate photos and go.

Just wanted to share me and my wife's experience in at the Memphis Sub-Office on January 5, 2004. The Memphis office is severely backlogged currently in regards to AOS and EAD applications. We filed the I-765 for my wife on September 10th and hadn't heard anything. After corresponding with our congressional representative, we were told to travel to Memphis (a 350 mile trip) on any Monday to receive an interim EAD. We traveled to Memphis on Sunday to be ready first thing in the morning. Sunday night we decided to check out the office and went to the front door.
EAD was renewed within one week
I had filed for my EAD renewal 3 months before the expiry date (September 16th). While my EAD was approved a little before 90 days, my wife's EAD was not renewed. They requested additional evidence (marraige certificate and I140 approval notice). After USCIS received the evidence and the USCIS website was updated, we went to Memphis on friday, January 2nd, 2004 (the day of the week when interim EADs are issued in Memphis) hoping that they would issue an interim EAD (since it was more than 90 days after the original receipt notice).

Mr. Rajiv Khanna, Mr. Kunal Sharma and the rest of the team have been very patient and extremely supportive.
I had filed for my immigrant visa through my spouse, and it was quite complicated. Couple of the other lawyers we spoke to said that there are no chances in winning this case, but Mr Khanna was firm, that the fundamentals are right and thus we have a good chance. Finally, after 2 long years, my immigrant visa has been approved.
What impressed me the most is the Mr. Khanna would immediately schedule an appointment (no charge, of course) every time there was some news from the immigration office or from my side. Even during the final stages, I had asked him a few questions regarding my DS-260 as i was very nervous, he scheduled an appointment immediately and told me exactly what to answer in each question. They made me feel as if I was their only customer. Excellent effort and care for each case by the team, and I would surely refer his firm to everyone.

Withdrawing one pending petition (H-4) when another is (F-1) approved

My H-4 to F-1 is approved on October 08 2015. My Spouse Employer filed H-4 extension for me which is currently in Process. We sent this H-4 withdraw letter and it has been reached USCIS (Vermont Service Center) on Oct 13th 2015. Could you please let us know approx when do USCIS withdraw this H-4 extension?. If by mistake USCIS approves this H-4 Extension, can we fight with USCIS to withdraw this H-4 extension?

Forms For The H-2B Program Been Extended Temporarily
The forms for the H-2B program have been extended temporarily until November 30, 2015 while OFLC awaits approval of its request for a three year extension under review with the Office of Management and Budget (OMB). OFLC will continue to extend the forms in one month increments until approved by OMB. A second comment period, as required by the Paperwork Reduction Act, ends November 30, 2015.

I am on H-1B visa and in green card process (waiting for I-485 date to become current). I would like to know if I buy and rent houses on my own name (without forming an LLC) and actively manage the activities (finding a renter, maintenance etc) and make profit out of those rentals, then would it violate my status?

Priority date loss upon revocation of I-140

1) Is there any difference between I-140 revoked by employer - vs - I-140 revoked by USCIS (say for fraud or misrepresentation) with respect to being able to retain the priority date with the new employer ?<br>
2) Changing from Employer A to Employer B - If Employer B files the PERM before I-140 by employer A is revoked by the employer A - would that help retain the PD corresponding I-140 to employer A ? In other words, are there any specific scenarios in this case - where the PD could be retained based on the first I-140 approval ?
As far as we know, USCIS has once again revered its position and has stated that priority dates will be retained if the revocation is based upon an employer's request. See: the blog entry here

Writ of Mandamus against delay

I am currently pending I-485 (EB3, skilled worker employment based, priority date Oct 2008) since April 2014. I submitted inquiries through congressman, they received a letter that my case is on hold indefinitely. Do you recommend filing Writ of Mandamus or would that cause a denial? What other actions can I take, I've submitted a case through the Ombudsman and met with a USCIS officer through Infopass appointment (who told me nothing). No RFEs have been issued for this case, I-140 was approved and fingerprinting done (twice, since first set expired).

USCIS has published an update to Form I-765, Application for Employment Authorization. The new edition is dated 11/04/15.
I tried 2 different attorneys before employing law offices of Rajiv Khanna, one attorney took money but didn't even bother to call me and other who wouldn't fill the basic information properly before filing the application for LC. Myself and My wife, we got our passports stamped yesterday (11/21/2002), the whole process took us about 2 yrs and 1month without any problem or query from INS.
