Below are questions I have on the H-1B Amendment and H-1B transfer being filed almost at the same time with little gap with USCIS for the same person. The H-1B Amendment is in light of the new H-1B regulation that has been mandated by USCIS when there is a significant change in the Job Location of the beneficiary from the address mentioned in the initial Petition from the employer which was approved initially.

1. Does the USCIS Last action rule apply in case of the below 2 being applied almost at the same time for the same beneficiary?
a) H-1B Amendment with Current Employer
b) H-1B Transfer to New employer while H1B Amendment is pending with Current Employer.
2. If the answer for the above is 'Yes', then incase the H-1B Amendment Approval comes after the H-1B Transfer would the H-1B transfer to the new employer that was approved earlier be automatically nullified?
3. If the answer for #2 above is 'Yes' Is there any way to request USCIS to consider the H-1B Transfer approval to new employer as the primary incase that get approved earlier and avoid the H-1B amendment to dictate the latest H-1B for a given employer? (I believe we can request USCIS to withdraw/cancel the Amendment but is this something that the new employer/employee can do or only the existing employer who was filed for H-1B amendment has the authority to request any cancellation/withdrawal of the H-1B amendment?)
4. Also does the current suspension of H-1B premium processing apply even for the H-1B transfers (with a new extension for 3 Years) or is it only for new H-1B extensions of Petitions from the current employer?
See clip from Attorney Rajiv S. Khanna's conference call video that addresses this question.
I am currently on EB-3. I have a company (say Company A) which is willing to file for my GC in EB-2 under 'Future Employment'. Do I or the 'company A' need to be aware of something on this front?

The H-1 quota cuts down 50% or more applications each year.
yeaaaahh..i am so happy and that wouldnt have been possible w/o this forum and all the help I have received!
We had our interview appointment at 11.05. We left home at about 8.00. And of course, Chicago would not be Chicago if there was no traffic jam, so we left the highway to take an alternate route. After spotting the INS building, we looked for a parking. We enter the building at 10.00.
Alright, first off thank you to everyone that helped me out with what to bring!
We showed up with about 30 pounds of paperwork, photos, tax returns, wedding albums, cards.
Our appointment was at 1 pm, we arrived around 12:15. We got in the lineup, and waited. and waited and waited. (got a little warm considering it is still in the high 80s, 90s) At about 12:55 they let us in along with a swarm of other people coming in for the same thing (and some naturalization cases) We signed in, and waited right up at the door to be called.
Here are some experiences with regards to my entire track from NIW I-140 petition to I-485 approval. I had somewhat of an unique case, so if anyone here is in the same boat, this may be of help to you. I have done the entire process by myself, without an attorney, and long hours of research in the law library on U.S.C. Section 8.
Arrived to US in 1991 on J-1, not subject to section 212e, changed to F-1 on arrival. Became an H-1 in 2001 and filed for NIW in March of 2002, case was backlogged due to 9-11.
Based on the advice of some of the members at immigrationportal and being an eternal optimist, I went to Vermont Service center on Aug 23rd taking a dayoff. The lady in the counter told me that my file is in queue for FP scheduling. I told her that I got the same reply even two months back when I made senatorial enquiry.
I had my interview today in downtown miami. The entire process took just less than an hour of which around 45 min was the wait for my turn. I had taken so much with me but nothing was needed except the passport and green card. I did get one unusual question related to my mailing address. I have always used a P.O Box as a mailing address so she just asked why P.O Box, why not use the home address. I just told her I change residences quite often ( am a single guy ) and its just easy for me to get a P.O Box near work.
Today I had my interview conducted, and passport stamped as the final result. I finally can draw a closure for this 27-month-long journey. Honestly and surprisingly, I was extremely calm when I arrived USCIS office 4 am today. I was reading one of my favorite authors' (Ann Quindlen) bestseller " One True Thing" while I was waiting in the waiting room so concentratedly that when my name was called, I realized that my eyes were full of tears (yeah, the story's very touching and real. ) Anyway, here's my detail report to all of you who are still waiting:
I deeply appreciate all the helps from Rajiv Khanna's firm to my journey of PR. All the staff here I have been contacted with are knowlegable, and warm hearted, which light up so many dark nights of mine in the past. I would like to give my special thanks to Prerna, Shivane, Suman, Richa, Charu, who not just helped my case but also give me the hope as well.
Thank you all!
Rajiv, Anna and the team was great with their help regarding my H1B transfer, particularly with their thouroughness in responding to an RFE.
Thank you all again!
-Sonali.
I was approved for H1B which would be effective on 1st of october,2005. But I didn't get my I-94 with my H1B approval. Before 1st of october, I left my previous employer and joined with my current employer. On that moment, it was tough for getting the new H1B. But Law offices of Rajiv S. Khanna made it, especially Rena Wadell, who was handling this case. My spouse's H4B also on processing. Hopefully, get the good news soon. I am really happy for getting their service.
I was running out of time on my H1 B and had requested Rajiv Khanna's office for Quick filing and not only they filed my LC PERM on time but I also got my Approval in 4 days , All of my contacts (Suman ,Vijay ,Pramita,Anna Baker) at Rajiv Khanna's Office were very detail oriented and very helpful .I would like to specially thank Pramita for updating me with the case status ( at times on hourly basis ) when I felt unsure if I could make the deadline . Pramita and
Vijay took good care of my case and kept me updated with the status which is rare attribute which every cleint like me longs for . Rajiv Khanna Rocks !!!!

Dear All,
I want to inform the full story of my GC Episode. I am writing this on Sep-22-2004.
I was planning to apply for my GC during 2001 March. I was visiting many Attorneys office personally in Houston and through phone. I found out that, Attorney Rajiv S.Khanna was collecting the decent fees among all.
Then I checked his reputation. It was amazing. So, I contacted him through email.
Within 24 hours, with free of cost he talked to me. Listened my case and suggested me to apply through EB1 (OR).
I chosen him and his office gave me case number and opened a file for me. Then they assigned me to interact with one of Attorney’s Associates Ms.Diane D Lombardo. A Wonderful lady.
She walked through with me for the entire case (around 3 years). I could have asked at least 100 questions in my full three years, because my case was getting complicated. I lost my Job before I140 approval. I am a software engineer, so it is not a surprise for me. But, INS cannot understand that. I thought I lost my GC almost. But, Diane in continuous consultations with Attorney Rajiv rescued me from the deep problem. My sincere thanks to her.
Next Thankful person is Mathew Chaco. He also one of Attorney’s Associates. Great Person. Free to approach and also fast in responses. When my Finger Printing was not raised by INS. I approached him. He arranged for a talk to INS from Attorney office immediately. Within 30 days I got FP from INS. While many of my contemporary GC candidates are yet to get FP, I got it because of him and my GC also approved within 2 months after FP.
Next thankful Person is Ms.Suman. Over all supervisor. She talked to me several occasions. She is always to the point. If you approach for any issues. She will inform you the time for the reply. Exactly within the mentioned time (after the discussion with Attorney Rajiv or some times she arranged Attorney to talk to me) she will always reply with the possible positive answer.
All these questions I raised with them are free. Because I am a client for them.
Their office people also having excellent hospitality. Polite in answering and approachable.
BASED ON MY OWN EXPERIENCE, ATTORNEY RAJIV AND HIS ASSOCIATES ARE THE BEST LAWYER FOR IMMIGRATION RELATED PURPOSE IN USA.
Email me if you have any questions.
Good Luck.
Thanks to all the wonderful professional staff at Rajiv's Offices. The entire experience from getting a L1 visa to a GC approval within 24 months was awesome. I really appreciated the personal attention and constant updates on status. I also want to highlight the superior service Savita Krishnamurthy extended, many times going beyond the call of duty. You people are A1.
This is to announce to everyone that Offices of Rajiv Khanna extended their service without sparing any efforts to get my green card approved. I was extremely happy with their service and I'm more than willing to answer what I went through and how Rajiv helped me out.. Thanks.. Ram
Thanks for helping me getting my green card. Spacial thanks to Shivani Sharma, Liela Lehman, Sri, Diano Lambardo, Mathew Chacko and Vijay Durgam. Every body did good job in preparing paper work which helped me getting green card earlier than others.
I am working with Rajiv's office for over a year now. Staff is extremely professional and very prompt. I would highly recommend the firm.
My wife and I received our GC approval notices and got stamps on our passports on August 31, 2004. We are thankful to Mr. Khanna and his team for getting our GC approved. The whole GC process was not smooth but Mr. Khanna was very helpful all along. Whenever we wanted to talk to him for the problems we faced throughout the GC processing, he was always kind enough to spend his valuable time to discuss with us about our case. And finally after three years of struggle we have had happy ending. Again, we would like to thank Mr. Khanna and his staff especially Diane for the good job they have done for our GC process.
My labor got cleared under PERM on February 7th,2006. I started the whole process in December 20th,2005 with Rajiv Khanna as my attorney. I’m very grateful to Rajiv S. Khanna and team for helping me with my labor certification. Their guidance helped me to get all my paperwork right. They make it a point to educate us about the laws and update us promptly about any changes in the DOL. This makes us feel comfortable and generates awareness of new policies under PERM.
In short Rajiv and his staff made the whole process very easy, simple and painless. We are really glad that we chose this Law firm. We are greatly pleased with Rajiv and his staff as far as their professionalism, courtesy and promptness regarding my Labor. Many of my friends went through Rajiv and all of them are also happy like me. We are thankful to Rajiv and his staff.
