“An out-of-status scenario, for the H-1B visa holder and his or her dependents (such as spouse and children) would mean a three-to-ten-year bar from re-entering the country. The mechanism to redress an H-1B denial (including that of a transfer) is also highly inefficient,” said Rajiv S Khanna, managing attorney at Immigration.com.
Hai all... thought this might help someone trying to find some information for this FNU problem...First of all i had multiple problems....
This bulletin summarizes the availability of immigrant numbers during April. Consular officers are required to report to the Department of State documentarily qualified applicants for numerically limited visas; U.S. Citizenship and Immigration Services in the Department of Homeland Security reports applicants for adjustment of status.
The H-2B non-agricultural temporary worker program allows U.S. employers to bring foreign nationals to the United States to fill temporary non-agricultural jobs.

U.S. Citizenship and Immigration Services (USCIS) will expand Deferred Action for Childhood Arrivals on Feb. 18, 2015. That will be the first day to request DACA under the revised guidelines established as part of President Obama’s recent anouncements on immigration.
I have turned to Rajiv Khanna and his amazing team on a number of occasions. Most recently, to flush out a complicated immigration situation from France. The thing that impresses me most is his humanity, his vast knowledge, professionalism and generosity. Well, those are 4 things, not one. But it is hard to stop when posting a positive comment about Mr. Khanna's office and work. He responds immediately or has a staff member do so, and he will explore every possibility until he finds a solution. In the maze of disappointing immigration attorneys out there, I highly recommend him.
I have my I-140 approved under EB-3 category, even though I have Masters Degree from accredited US University. Can I change it to EB-2 now?
See clip from Attorney Rajiv S. Khanna's conference call video that addresses this question.
Rajiv and his team has been handling Green card and related applications for me and my family since 2003. My experience has been excellent, to say the least. The long and not yet completed EB-3 India journey has been painful but Rajiv and his team have been great pillars of support all through. Our series of EAD and AP applications have been promptly worked on and many questions/doubts have been answered/attended swiftly. I especially thank Rajiv for a recent no charge conference call to discuss a new development with my employer. May God bless this team with greater success.

Thank you
Just came to know from the USCIS website that our I485 petitions have been approved and cards have been ordered. I want to thank each and every member of your firm who were with me through this long road that took 4 years and 7 months to travel . My sincere thanks to Richa Narang, Helen Anchillo, Kumuda Prasad, Attorney Jitesh Mallik and Attorney Mathew Chacko for handling various stages of our application process in the most efficient and professional ways possible. We call ourselves permanent residents today only because of the help and guidance that you provided and we sincerely appreciate your services. Specifically I would like to mention the promptness and efficiency that was shown by the team in responding to the I-140 RFE. During this past 5 years, there was never an email or a phone call that went unanswered from your office. That really shows how professional you are as a team.
My sincere thanks to you Mr. Khanna, for all the help and guidance that you
gave us through out the application process. You were always ready to answer all my questions (whether GC related or not) and I really appreciate all the help that you provided.
