Rajiv S Khanna, Managing Attorney at Immigraiton.com told TOI: “Changes like imposing per country limits on H-1B visas will most likely require a legislative mandate, which can only be secured through amendment of laws passed by both Houses of the Congress (US Parliament). It is highly unlikely that a provision like this will make it through the Democrat-controlled House of Representatives. Neither visa extensions nor new H-1B visas can be affected in such a profound manner through an executive order or action without legislative mandate.

Situation:
Resigned company A already and Got offer from employer B and applied H1B transfer(premium processing) but received RFE. But I have another offer from Employer C as well who is yet to file my h1b transfer
Question:<br>
1. If RFE is denied for employer B Can i join employer C with the receipt notice as Employer C has started H1B transfer by that time ?<br>
2. How long one can stay in US without job/payroll having H1B ?

Form I-864, Affidavit of Support under Section 213A of the INA, is a contract an individual signs agreeing to use their financial resources to support the intending immigrant named on the affidavit. Effective March 18, USCIS has updated policy guidance in the USCIS Policy Manual (PDF, 362.73 KB) regarding the Special Immigrant Juvenile (SIJ) classification based on the settlement agreement resulting from the Saravia v. Barr class action lawsuit.
1. I have employment based green card and is expiring on 03/12/22.I am not employed now. Do I need to be on job at the time of renewal.
2. Can I renew my card or apply for citizenship which is better or do both. Can job be any kind (can be non-related job) or same job.
3. How long one can stay out of country, heard it is not more than 1 year. If I could not return to US and my GC expires, does it treated as abandoned.(it is expiring in a year)
1. No.
2. You can actually do both.
3. The basic idea is if you leave the United States for less than six months at one go usually you are okay, you are not questioned too closely, but more than six months they question you very closely because of certain technical reasons.
At one year outside you lose your green card automatically unless you have something like a re-entry permit. If on the other hand, you are a U.S citizen there is no requirement that you have to stay in the United States. You can stay anywhere in the world, never have to come back again and you would still be a U.S citizen.
