If I may verify the processing times involved in NIW. Since it falls under EB2 category, I am assuming it may be a long time before I can get my EAD card and be able to change employers. Also, I want to confirm if there could be issues if I change employers during the process - If so, I'd prefer to change my current employer before starting with it.
You can change employers any time if you are a self-applicant and will continue to work in your stated area of national interest. But NIW priority date will take the same time as a normal EB-2 application does. See:

We were recently retained by an employer whose employee fell out of status due to an omissions by the former counsel. Prior to the employee’s H1B expiration date, the employer tried to file an H1B extension. The employer’s former Counsel utilized an obsolete and inappropriate wage source when filing the LCA. This wage amount was also not representative of what the employee was earning. As a result, the employer had to withdraw the LCA. This circumstance resulted in an untimely filing of the employer’s H1B application and the employee’s status expiring due to no fault of his own.
I have engaged Rajiv's office for over 10 years now for many different reasons. I've also been recommending Rajiv's law offices to my aquaintences & friends for over 10 years now. I have very close examples of people who lost 3-5 years going to some other lawyer & later, at my advise, going through Rajiv's office, who somehow 'fixed everythin' ???? Rajiv once told me ... ' why do you want to engage my office? this is so simple, you can do it yourself and save some money..." if you expect more from a lawyer... you are crazy!!!!! For Rajiv, its not about the money... he REALLY wants to 'do the right thing'. Rajiv provided me guidance for a new case - at no cost just because I was a old client - & literally advised me I could save money by doing the work myself - it was very simple. I was infact, ready to pay him or some other lawyer 100s of $s because this was a inquiry near & dear to me. There is no better example of honesty & forthrighness ( i've dealt with many lawyers in my lifetime & if you have a better example, I'd certainly like to hear it) . I'd ( & have already ) recommend Rajiv for his unparalleled knowledge & honesty in a instant & have also, personally, gone back to him time and again - H1B , family visas, family GC, company visas etc etc etc - again & again......its a no-brainer for me... & yeah.. I'd put my money where my mouth is.... --DJ
Mr. Khanna and his staff is fabulous and extremely accountable! I recently had one on one conference call with Mr. Khanna and his assistant Rena and I was so much impressed with Mr. Khanna professonalism and knowledge. If I have to recommend any lawyer in future to any person; Mr. Khanna and his staff will be my first choice. God Bless Mr. Khanna and Team! Muhammed Nadeem Ibrahim
A recruiting firm for accountants retained our services to file an H-1B petition for a recruiter. Typically, it is difficult to justify that the position of a recruiter qualifies as an H-1B level occupation. Our petition to USCIS argued, however, that even though recruiters do not generally qualify as a specialty level occupation, the present case is different because the beneficiary will be hired as an International Accounting/Finance Recruiter.
I had an accident and am on disability while my green card adjustment of status application ( form I-485 ) has been pending for over 4 years. My I-140 had been approved about 5 years back but my case has been caught up in the visa backlogs at USCIS and Department of State. I wanted to know if there was any provision for help in the immigration laws, in case I am sent for long term disability or my employment is terminated before I receive my green card. I learnt that employment and disability are subjects to be discussed with a benefits or employment attorney. The only immigration benefits are via AC 21 or via a private bill. Also, that one should not loose the advance parole anytime while the AOS is pending. I want to thank Mr. Rajiv Khanna for his generosity with time and expert guidance. Over the phone I found him to have a very pleasant personality. he had me feel comfortable and didnt seem money minded at all.
For success in any area, you need a team of good people around you. For spectacular results, you need a team of great people. This is true in all facets of life. Finding the right team is key. I think I was very lucky to come across Rajiv and his company, almost 10 years ago. Not only has Rajiv been phenomenal, I belive his team is his real core asset. And in working with immigration.com, I was lucky to have this team on my side. Over the years, I have utilized their services for many projects for myself as well as many others in my company. H1's and Green Cards primarily. What has been key is: 1) Accessibility - it's very easy to approach Rajiv or any one else on his team. Rajiv has even hosted free conf calls for clients on weekends when the situation has necessitated it. And has been easily available for personal conf calls at short notice. 2) Knowledge - the breadth of knowledge that he and his team have in their expertise areas is amazing. They know the answers or know where to get them quickly. I see Rajiv as someone who is well networked and is a subject matter expert appearing on prominent news channels to help educate lawmakers and community. 3) Candor - I see Rajiv as a very straightforward and factual person who will provide all options and best advice / recommended course of action. 4) Focus on customer service - the focus is always on customer service. I (and all the people I referred to Rajiv) never had to face a problem with customer service issues - we always had quick responses to our questions. Rajiv's team understands that they help clients with decisions that impact their life and companies with decisions that can help their bottomline. A lot of times these are time sensitive. I have seen the team putting in extra long hours and working through weeknds when it was critical - especially in 2007 when all priority dates became current and many many clients had to file completed applications in a matter of days and weeks. 5) People - the biggest asset - and I can say that the core of his team has been there for atleast, almost a decade. Heather, Leslie, Anna, Judi- they all have been exceptional in their interactions and follow through. It is truly a pleasure to know them :) Thank you, Mudit
We assisted petitioner, a public accounting firm, in filing an H-1B petition for beneficiary for the position of staff accountant. We received an RFE requesting additional evidence that the position qualified as a specialty occupation by satisfying at least one of the four qualifying criteria for a specialty occupation. In our lengthy response, we argued that the job duties, as detailed in the petition, and as compared with OOH’s job description for staff accountant not only comports with but goes beyond OOH guidance in its uniqueness and complexity.
Immigration.com has provided fabulous service for the multiple cases that I referred to them for my firm. Their clarity in approach and domain expertise makes these elaborate process seem very simple. Staff employees are courteous and sensitive to your needs. The best part is personal attention from Mr. Rajiv Khanna to every case that I dealt with him on. Nothing but FABULOUS is my experience. All the best to Immigrations.com and the firm. Abhishek
A sound and pragmatic advice. Very professional and courteous. Very impressed for the sound judgement.
I had a very good experience. I hopped to a 10 minute conversation with Rajiv Khanna where he answered my questions around GC maintenance, adoption, etc. This first call was at no charge.
It was a pleasure working with Rajiv's office on an H1 application for our employee. Though there was a considerable amount of paperwork required as a result of the increased diligence from DHS lately, we got good instructions with clear guidelines on what was needed at each step. Anna and Fran answered our questions very promptly and capably. They were also very careful to consult Rajiv on any legal opinions. I know Rajiv handles a lot of cases, but with the processes he has in place and attention his staff gave to this case, we might as well have been his only client. Thanks Rajiv, Anna and Fran.
Law offices of Rajiv S Khanna handled my H1B visa application. I am on H4-EAD and the initial consultation from Mr. Khanna was immensely useful. The team members, Shilpa and Anna were very responsive and proactive and the entire process was smooth. I strongly recommend Law offices of Rajiv S Khanna for visa and immigration purposes.
I had few questions on EB1C filing;
- I am here in the US from 2015. Prior to that I was working as an Manger for the same firm in India.
- I was appointed as a Principal and then promoted as a Solution Manager last year. My role involves tasks during the entire duration of a given project and as part of the project I co-ordinate with the offshore teams assigned on the project for deliverable and to assign other tasks related to the project.
1. As part of EB1C filing is there a mandatory requirement that a manager should be having dedicated team members
2. If 1 is yes then can we consider the offshore team members assigned per project who would be supervised to the level of getting status of tasks, providing clarifications, training them etc.
3. Is there a minimum number of reports required in the US and while I was in India, and if those reports have left the organization is that Ok?

Mr. Rajiv is very helpful to Indian community through community call as well as to students.. he has profound knowledge in all category of immigration from employment to family. Very satisfied with consultation. Thank you very much.
I want to Thank Rajiv ji and his team for the invaluable services they provide. While maneuvering the arduous process of immigration, most immigrants need an attorney who understands their concerns and has no qualms in going above and beyond the business relationship. Mr. Khanna and his team do just that..... Go above and beyond. I had burnt my fingers with a law firm in NY, and I had become cynical about the whole process and about the abject indifference some law firms have towards their clients. I consider myself extremely fortunate to have come in contact with Rajiv ji. The best part of Mr. Rajiv khanna's Team is that it comprises of like minded, highly professional, and empathetic individuals. Rena, Anna, Sumanji, And Jagbir took care of my case as if it were one of their own. I want to express my heartfelt gratitude for all their sincere efforts and formidable support. Thier professionalism coupled with empathetic attitude is a perfect antidote to the challenges one has to endure during the immigration process. I strongly recommend Mr. Rajiv Khanna and his stellar team. Thank You, Thank You, Thank You. Sincerely, RM.
I have been interacting Mr. Khanna and his office for my Green Card processing. They have my taken case as though this is one single case that they are handling and giving all the attention it needs. I am confident with this team, I will eventually get my Green Card and am thankful for the team.
Ours is a long story. My green card was filed under EB3 India with a PD of May 2006. My husband's green card was filed under EB3 India in 2005. When our dates became current sometime in 2007, my I-140 was already approved and his was pending. So, we decided to go ahead with my case and filed for I-485 for both of us. However, the dates then retrogressed and our lawyer informed us that my husband's case is no longer valid since his LC expired 3 months after it was approved. We didn't know that LC expires if not used within a specific time frame and the lawyer did not inform us either. Anyways, my husband's GC was again filed, this time through Rajiv's firm with proper guidance and through EB2. Rajiv also guided us to go through Consular Processing instead of I-485 since in our case, my husband could legally work using EAD via the I-485 applied through my case. In all these years, the company I work for has increased in size and wants to promote me. I consulted with Rajiv regarding this and inquired about possibility for porting from EB3 to EB2. Rajiv answered all our questions and guided us appropriately this time too. We are now waiting to hear about the Priority Dates for October 2012 bulletin and will make a decision about EB3 to EB2 porting. It feels so good to be able to talk to Rajiv regarding these questions related to immigration and his knowledge and experience in this field is very very valuable for people like us. Every time we have talked to him we have received excellent response and guidance. My husband and the company he works for had a very good experience with EB2 filing. Everything was very professional and was checked and rechecked before it was sent through. Thanks to Rajiv for all his help with our case so far!
I have been dealing with Mr. Khanna and the team for the last several years. I always felt that everytime you encounter with team, there is continous improvement in handling cases professionally. He is very through with the law and more importantly pragmatic. He giudes the clients in the right way. A great firm to work with, as he has dedicated staff and his services are always praiseworthy.
Rajiv and his team are simply awesome. Rajiv knows the subject matter and is very thorough with all the rules and regulations. I was impressed with the humility, simplicity and honesty.
I was assisted by DIane Lombardo a colleague and team member of Rajiv, who was diligent, detailed, prompt and persistent. Diane is highly focussed, paid attention to minute details and analytical. Diane always responded to calls and emails within 2 hours, and referred the matter to Rajiv, whenever required for specialist advice. A great team indeed. Anna Baker also was involved in the coordination and I did see that Anna made extra efforts to ensure all documentations are perfect.
I highly recommend Rajiv and team for all immigration related work.
We won a case for Alien of Extraordinary Ability a Mathematician holding a Doctorate of Mathematical Science, numerous “invited” publications and presentations as well as several prestigious international awards. We were able to provide evidence of extraordinary ability through letters of recommendation from leading mathematicians around the world. This applicant had strong support from the U.S. government and industry.
Dear Rajiv & Diane, Thank you for taking time to talk with me yesterday. I was trying to make my case an O-1. Rajiv was upfront in letting me know that it was not an O-1 case. Prior to this, I also benefited from his invaluable advice, which he didn't charge anything, to have got a Back Pay for 10 months. Rajiv earned my trust with his honesty, knowledge and generosity. I would recommend him to those who are in need of professional services in immigration. Best regards, Wendy Zhang
