In June of 1998 I changed jobs, and moved here to Florida in July of 1998. I began filing for new H1 visas in May of that same year. It took Just under two(2) months to get our H1-B and H-4. Just recently (Dec. 1999) our application for Alien Employment Certification, through the Atlanta DOL was approved. We are now in the process of filing our I-140 and, once the priority date becomes current, the I-485 (adjustment of status for GC). My wife and I are extremely pleased with the results Mr Khanna has been able to achieve since we first started with him in Maryland. We have come a far way, and it is refreshing to know that changing lawyers was the best choice we have made throughout this ordeal. I got my passport stamped last week to complete the GC processing. I am thankful to Mr. Khanna and his cooperative team for all the effort they put in for my case. I am impressed by the attention to the case provided by the entire team and also the backup measures that were taken to ensure speedy success. Overall it was a very pleasent experience. I had chosen Mr. Khanna over my company's lawyer and I feel it was a wise decision. My Labor Certification papers were filed in May 99 and the Center was VSC.
I got my GC approval on July 11 after a Interview at LOCAL INS Baltimore. Thanks to Rajiv and his team. I do not want to mention any of the staff members name as all the staff was prompt (Very important to me) and were extremely helpful. I really appreciate them answering all my questions patiently throughout the case. Like most of Desis, I was also asking same questions again and again in different ways but his staff were always patiently answer all my questions politely. Hi, I got my GC approval on June 20th (filed mid Aug 99 at TSC). Kudos to Rajiv and his team, esp. Diane who handled my case. Both Rajiv and Diane were extremely helpful. I really appreciate them answering all my questions patiently throughout the case. Esp. email exchanges with both of them works great. I got replies to all my emails within 24 hours. At one point (March/April) after filing I-485, I was thinking about doing counsular processing. Rajiv asked Fidelina to check on status and suggested that we wait for a few more months. I started my GC processing in Sept. 98. Rajiv and his team got my LC done in Apr 99. I filed my I-140 in May 99. There were some questions regarding the valuation of my degree and experience. But Rajiv and Fidelina went out of way and got second evaluation of my education done which fitted the case in the EB2/RIR category. My I-140 was approved on 7 Dec.99 and now I have sent my I-485 papers for filing. Thank you very much Rajiv, Fidelina , Suman and the entire team. She can travel with a B-1 visa as long as she tells the truth. L-1 and H-1B visas are the quickest paths.
I got my H1B visa approval recently and I have got my stamping date in May. My company is going through a bad phase financially and has had 2 layoffs (might do another layoff in next few months) I go to India for stamping and get laid off before getting my visa stamped (Can I come back to the US with 60 days left? Can I get my visa stamped if my company pays me for another month or so considering that my last day is a month later? Can I get my visa stamped even if my last day has passed)I go to India for stamping and get laid off after getting my visa stamped (can I come to US and do my job search) If I get laid off while in India but have an offer letter from another company (H1B transfer done/ transfer to be done after returning to US)
This is a pertinent question. I don't think you should go for visa stamping if you have been laid off. If you do go, you should make it clear to the consulate that you have been laid off. However, under the law, you have a 60-day grace period during which you intend to apply for another job. I don't think it's going to work like that. I don't remember the details of the regulation off the top of my head, but I think there might be some restrictions against travel.
An offer letter is not good enough just to get the H-1B approval. Then, I don't think there's a problem with traveling.

Employer A - 140 Approved in 2013. EB2 category.
Employer A - Provided form 485J in Aug and I applied for I485 in Aug. My dates retrogressed to Oct 2011 now.
Employer A - Desi consulting company, we couldn't find a project for me to join them and they withdrew I-140 in Jan. At the time of the I140 withdrawal I485 was at 150 days timeline. Now that 180 days have passed since I485 was filed in Aug, can I provide 485J with my current employer to port the I485 application? Will USCIS approve porting or deny as I140(approved in 2013) was recently withdrawn before I485 reaches the 180 days mark? Is there any way to appeal the withdrawal of I140 as beneficiary with pending AOS or ex-employer can withdraw without any issue? Are there any laws to safeguard the beneficiary when dealing with abusive and mean desi consulting companies?
