EDD Sacramento fowarded to DOL, San FRancisco on April 13. DOL recd my app from EDD on April 17 and APPROVED it on APRIL 28 (11 days at DOL). I am on H1-B Visa and my Approval (I797) is Valid Till October-2010 However My Indian Passport is Expiring on 26'th-Aug-2009. I just came back from India a week back and Immigration Officer has Issued me I94 Till my Passport Expiry.. Is thr any other way for me to Apply for I94 Extension based on Approval validity without Leaving the Country ??? or i have to leave the Country & Come back ???

Whenever CBP gives you an I-94 with mistakes on it, they can easily correct it if you just go back to the airport and request a correction. Most airports have CBP office hours. In my view, they should issue an I-94 co-extensive with your approval, not your passport. So, go back to CBP. Post your experience here for all.

I entered the country back in 2019 to complete my Masters degree (F1 Visa). I am on an H1-B visa, which was approved last year (10/01/2022 - 10/10/2025). However, I have yet to go to India, so visa stamping is incomplete. I got laid off on December 14, 2023, so I am on my 60-day grace period. Suppose I cannot secure a new role within the 60-day grace period. In that case, I am considering changing my status to a B2 visa to extend my stay and continue looking for an opportunity. However, since my H1 visa is not stamped, will that create an issue filling for a change of status to a B2 visa? And when I land a new job returning from B2 to H1, would that be an issue since the visa won't be stamped either?
As long as you have a change of status, such as an F-1 to H-1B change, visa stamping is not an issue when transitioning from a B-2 to H-1B. The key consideration is the validity of your I-94 while inside the USA.

Hi, My wife and myself received our I-485 approvals the last saturday. Rajiv, Fidelina and their team did great job in getting my GC. I didn't have lot of time on my H1 when I started my GC (right around 2years), but I got my GC within 1year 8 months. Here are my details: EB2 India, PD is Sept 98, LC done in 7 months through RIR, Got I140 in 3 weeks. I485 RD is Aug 99. Got EAD/AP within 2 months. FP done in Oct 99. 485 approved May 23, 2000. The best thing I did is hiring the Rajiv and the gang instead of going through the company lawyer. I saw my friends in my company having lots of troubles with the company attorney, who doesn't have current knowledge of ever changing immigration laws. Great job guys! Thanks Puri
