Thanks to Rajiv and his team. My LC was filed in Nov' 99 and got approved on Nov'12th 2000. Applying for I-140. This team is very prompt, patient, energetic and knowledgeable. The team reply to every question very carefully. Rajiv even replied to some personal immigration questions when I need to change my wife's H4 status to F1 (we went to Mexico for this). I would rate my experience with this office as above average. Without a doubt, Rajeev has an excellent command over immigration law and is a very approachable person. He answers all queries very precisely and within 24 hours. He gives an exact analysis of the available options. My case was handled by Diane. Again, an extremely efficient person. She would answer my questions right away and many times on weekends. Room for improvement: Clients should be able to get within 24h phone appointments with Rajeev. Once I called law office on a Friday afternoon to speak with Rajeev, and the operator offered me next wednesday afternoon as the nearest possible appointment. However, this happened only once and all of the other times, I was given an appointment within a day or two. I must also add that not all of the staff was as efficient and professional as Rajiv or Diane. Accounts people did some miscalculation on my account and it took me numerous emails to get that fixed. These issues, though minor, should be handled promptly and responsibly.

My GC process was started towards the end of 1999. After the Labor Cert. was approved, my I-140 was filed for. At this stage there was an RFE on my I-140. The case was complicated and at that point of time it seemed that there were very few chances of winning it. However, Mr. Rajiv Khanna presented the case with all the additional documents and evidences that were requested by INS, in a very systematic, efficient and intelligent manner. He was very persistent and determined to have the case resolved favorably. My I-140 was finally approved last week. Green card experience : I would like to thank Mr Rajiv Khanna, Fidelina and their staff for all the help they provided through my Green card process. I am glad I selected them as my lawyers and would recommend others too if they want a hasle free green card processing. My Labour was done in Feb 98 and it came in under 6 months. We tried for EB2 I140 but since I did not have masters, we got an RFE. We selected EB3 as an option then but due to some confusion at the VSC side, my I140 was denied, they thought we are asking for EB2 again. My date had luckily become current at that time. Due to the quick response from Fedilina, my 140 was approved in about a week or so. That was something really extraordinary and I am glad Fidelina was handling my case. We are able to file 485 at that time, Aug 99. Got the EAD in about 3 months. But unfortunately, the dates went back. At that time, my wife’s 140 got approved in EB2 and through another lawyer. Her date was current. We were in a dilemma whether to file another 485 while earlier 485 was still pending, do CP or just wait. We finally decided to go for CP. We had our interview on 25 October at Delhi and had to wait for 2 weeks at delhi because of Name check problem. Fidelina had been nice to answer my queries every now and then through the whole process. The CP process was very smooth without any problems. Rajiv's staff is well informed, prompt and very friendly. I had no problem during all the phases of processing. I received prompt response to my emails and Rajiv or his staff members were easily available to answer any questions. Further he has a real good system to organize and store documents; because of which I never had to refer to any of my old documents over the course of my 3.5 years of Green card processing. I have an approved I-140 with COMPANY A. However, I have recently moved to COMPANY B, and they have initiated the green card process on my behalf. I prefer not to include my experience with COMPANY A in the PERM filing with COMPANY B. My understanding of the terms with company A is limited, and I may encounter difficulties in obtaining experience letters and supporting documents from COMPANY A. Could omitting my experience with COMPANY A cause any potential problems when COMPANY B files the I-140 & PERM and requests the previous priority date from COMPANY A.
There is no need to omit past employers.

U.S. Citizenship and Immigration Services (USCIS) today announced changes to the way USCIS issues receipts for L-1 nonimmigrant intracompany transferees (executives, managers, or specialized knowledge professionals) under a previously approved blanket L petition.
I have an EB3 I-140-based EAD currently. If I set up a software firm for myself, can I sponsor EB2 or EB1 I-140 for myself? The main reason why I want to sponsor myself is I would not be under the constant fear that my employer may withdraw my I-140 for one or other reason. I will be able to work for myself. Is there any rule that stops me from filing an employment-based immigration petition for myself?
The answer is largely No, except under limited EB-1C circumstances.
I am on H1B with company A and currently working remotely from India. Given US rules don't apply in India -
1. Can I work for company B which is based in India and whose payroll also runs in India?
2. Can I start my own company in India while being on H1B for a US company?
The answer to both questions is that there is no problem.
1. How can I set up an LLC/CCORP company for a startup while on H1B?
2. How to become a board member and founder without being an employee while maintaining legal H1B status as per USCIS?
As long as you are only dealing with the USCIS and don't have to travel, I don't see any problem. The key factor is the employer-employee relationship, not the ownership.

I have an approved I-140 (Approved in Feb 2022) which is already 6 months past the approval date & my priority date is August 2020. I am currently on H1B visa where I have already completed my 1st 3 years and currently am on the 1st 3 year extension.
My question is :
1.If for any odd reason I lose my job in the US, and I am not able to find another job within the 60 days grace period, what alternatives do I have within the US and find a job (H4 is not an option for me currently) ? Would joining a consultancy be a safe option to stop accruing unlawful presence OR compelling circumstance EAD ?
2. If I decide that going to India is a better option and want to come back after some time to the US, would I be subject to the H1B lottery at any point in future if my 6 years of H1B is exhausted ? What information or documents are needed to assist for returning back to the US ?
1. B-1/B-2 is another option. Please visit the blog entry on this issue. One might consider refraining from joining a consultancy unless they have a specific project.Compelling Circumstances EAD is not that glamorous, the reason being that it takes a long time to process.
2. You can, of course, stay here while it's being processed, and then it's only given for one year, requiring you to extend it annually if you go to India. B-1/B-2 is reasonably a good option; all you need is a copy of your earlier H-1B approval notice, and that should be enough.
