Hi everyone I have finally been granted asylum. I filed my case in November of 2014. A lot of people said it will be difficult for me to be granted because I have been travelling in and out of the US for a long time.
Wanted to share that I had a trip with my mom to Europe back in September we both had RTD flew to Germany with delta and got stamped in less a minute by german passport control then we flew same day to Barcelona no problems at all then spent few days then flew to Athens and all went well they just checked at the gate took a look at out RTDs and look at the entry stamps and we spent few days in Athens everything was fine and then we flew to paris at the airport at athens while boarding the boarding agent checked our RTDs while boarding didn’t know what’s th

I am working in USA with the J1 visa as Postdoctoral Fellow. In April 2017 my girlfriend tried to come to USA and she was refused under the section 212a, because she told to the TSA agent that they did not have a serious relationship with anybody in USA, and they found out that she had sentimental links to me checking her phone, we were in bad moment in our relationship by that time. She has double nationality Venezuelan/Italian and she was trying to get in USA with the Italian ESTA. They removed her ESTA for ever and they told her that If she wan to enter in USA she is going to need a visa. Then I got married with her trying to get a J2 visa for her but the consulate denied twice her application under the article 214b, one in August ( after got married in Venezuela, and the other one now in December (on December we went together because I had to renew mine, but not success for her one).
Anyone who attempts to gain any immigration benefits, including visas, through perceived fraud or misrepresentation is permanently barred from entering the USA. In cases like this, you can try to revisit these findings with the consulate, but these are long, drawn out battles and difficult to win. Temporary visits may be possible with something called a 212 (d) (3) waiver.

I Just got license today... that too without birth certificate...
It happened like this...
I was trying for license in different DMVs... last week went to a DMV near to my house.. there they dont have facility for written test, vision test etc..
But they processed my application. The lady at the counter was nice enough and didnt mind my name problem in VISA.. she took photo and and signature.. then said, as i dont have a usa license, i've to take written test.. for that i need to go another DMV. And she issued a letter saying that..
Rules are strictly followed here. Only thing we need to wait for a long time.. This is what I did to correct my name everywhere
1. April 2005 - FNU - Passport, Visa
2. July 2005 - because of this SSN got delayed for 4 months and received with FNU
3. July 2005 - DMV refused to give license, because they cannot give license with FNU.
4. July 2005 - Enquired local newspapers in Philly - They told that I need to get court order number
am sharing the following info for all, i am sure it helps:
my parents came to US in mar2004, got 6 mon entry. 6-mo extn filed early aug, website showed approval late sept, approval letter recd early oct. they have come to US 2 times earlier (2000 for 1 month and late 2002 for 5 mo). Note that we sent photocopy of I-94, NOT the original.
DOCUMENTS SENT WITH APPLICATION:
3 LETTERS: 1 from my father requesting extn, 1 from me saying I will take them around and will support them, and 1 similar letter from my brother.
I got my first TN in 07/96 and was content working with that until the Pigeon River point of entry decided that the TN for health care worker was good only for 6 months with the second one at no charge. Back then, dual intent was either ignored or didn't exist for TNs so I started the immigration process. I was in Kansas, so my labor cert took 2 years because there was only one person in Topeka working on them. If I lived in New Jersey, it would have been approved in a month. Once it was approved, I filed the I-140 and after that was approved, the I-485. There was no H1B involved.
I've been in the US for 13 of the last 14 years and over the years I've obtained 6 different TN's and I've been on an H1b for a total of 8 years. I was voluntarily out of the country for 1 year about 5 years ago, which reset my H1b clock.
The last status I had was a TN and that was after I was married to a USC (we were still deciding what country we'd live in) and finally I filed for my GC. My EAD was approved 2 weeks prior to my TN expiring and now I am just waiting for my GC Interview in 4 weeks.
Just want to post my success story to help all those silent sufferers who are looking for guidance on Vacation recapture.
My 6th year H1 expired on Oct-13-2004. My company filed for LC in Feb-2004 and I did not meet criteria for 7th year extension.

I successfully got my H1 (& H4 stamp) in Ottawa on March 8.
This was my third H1 stamp (second for the same employer)
It went very smooth...hardly 5 min interview...
Things seem to have improved a bit. Applied for EAD (J2 Visa holder) online on September 2. When I checked the status of the case, I got the message that my EAD had been approved on November 8. Sounds great, but lets wait until the card has arrived.
By the way, if you want to apply for an interim EAD after expiry of the 90 day period, you no longer have to stand in line all night long but can make an appointment on the USCI site (http://usci.gov) at the INFOPASS section. Good luck to everybody.
I have worked with Rajiv Khanna, Anna, Ulysses and Kalpana for over a year and finally got my H1 visa a couple of weeks ago. It was a tough year for H1 visas, with an increased number of RFEs. But the attorneys handled my case very well and provided excellent suggestions at crucial points.
