I am just back from India after finishing the CP Interview in Chennai successfully. Mr. Rajiv , Ms. Fidelina Baptista and all his staff Suman Bhasin, Amel Berhe, Leila Lehman, Nimia were very helpful in the entire process. Needless to mention that Mr. Rajive is very good in handling EB2 cases. They did a great job in getting my labour and I-140 approvals and also cooperated very well in my persuit through CP instead of the regular I-485. During my I-140 stage, when I called and asked Mr. Rajiv that I want to opt for CP, he immediately agreed and accepted the challenge though it was not very popular at that time. I just got the I-485 approval yesterday in the mail and Rajiv informed me about it through an email. I thought I'll share my FP experience in Oakland, CA which might be useful to others. I had my FP scheduled for tomorrow but since we have other errands to run tomorrow we went in today at 8:15 AM. To our surprise they did not even question us about the date. They just glanced at our FP notice and gave us a form to fill up. Even before I finished filling my form my number was up.

I had my N-400 interview in Portland, Oregon this afternoon. At the end, the officer printed the N-652 form and checked two boxes: a) you passed the tests of English and U.S. history and government; and b) Congratulations! Your application has been recommended for approval.
The interview was smooth and quick. I had 2 tickets for speeding, which I had included in my N-400 application. He said it was good I had included them because I got a citation (ticket), but that they're only interested in violations that involve arrests.
The process was very smooth and lasted for 3 full minutes. USCIS officer was professional and friendly and started the interview right on time. He asked me to take the oath first and then reviewed the application. Then he asked me to write a simple sentense, went through history & civics questions (all from the list of 100 USCIS has on its website) and once I answered first six correctly told me that I passed the exam and the application is approved. He said I will get oath notice in 1 - 2 months.

I have an approved I-140 with COMPANY A. However, I have recently moved to COMPANY B, and they have initiated the green card process on my behalf. I prefer not to include my experience with COMPANY A in the PERM filing with COMPANY B. My understanding of the terms with company A is limited, and I may encounter difficulties in obtaining experience letters and supporting documents from COMPANY A. Could omitting my experience with COMPANY A cause any potential problems when COMPANY B files the I-140 & PERM and requests the previous priority date from COMPANY A.
There is no need to omit past employers.

I have an EB3 I-140-based EAD currently. If I set up a software firm for myself, can I sponsor EB2 or EB1 I-140 for myself? The main reason why I want to sponsor myself is I would not be under the constant fear that my employer may withdraw my I-140 for one or other reason. I will be able to work for myself. Is there any rule that stops me from filing an employment-based immigration petition for myself?
The answer is largely No, except under limited EB-1C circumstances.
I am on H1B with company A and currently working remotely from India. Given US rules don't apply in India -
1. Can I work for company B which is based in India and whose payroll also runs in India?
2. Can I start my own company in India while being on H1B for a US company?
The answer to both questions is that there is no problem.
1. How can I set up an LLC/CCORP company for a startup while on H1B?
2. How to become a board member and founder without being an employee while maintaining legal H1B status as per USCIS?
As long as you are only dealing with the USCIS and don't have to travel, I don't see any problem. The key factor is the employer-employee relationship, not the ownership.
