Long Process - but got GC through Mr.Khanna without going through RFE or any interviews. Lot of people helped through different stages. very professional. I would recommend to anyone to go through Mr. Khanna for GC.
Experience that exceeds my expectations. For People who count on quality and timely work this is the place. My labour certificate is approved in 2 weeks(EB2). Case Manage Amrita deserves honor and high appreciation.
What I can say is that I got the highest support possible even with all the troubles Rena, Savita , Anna and lawyer Rajiv stayed focused . They are the best. God bless you for all your great service. I just had to continue and say that , even though I was not the easiest of clients they stayed professional and polite . The billing department was very cooperative too. I am so happy to be one of your success stories . You made that the only option from day one. Thank you all.
I can not describe in words the gratitude that my wife and I have both for Rajiv Khanna and Jitesh Malik. The USCIS denied my wife's dependent I-485 AoS app and we were sure that we'd have to relocate back home. Jitesh and Rajiv bhai handled the matter deftly and we could not have been more pleased with the outcome. They took care of the matter and got us an approval when my old attorney wouldn't even return my calls when things started heading south. I had heard stories of Mr. Khanna being very helpful and knowledgeable and now know that he is the best Goddamn immigration attorney out there who is not afraid to fight for you.
To all desi's [Pakistanis;Indians] and non-desi's out there: Rajiv Khanna is da bomb! Trust me on that.
Thank you Rajiv bhai! Thank you so very much! Shariq Raza.

This is about my sister.she was born in mexico, and when she was about 4 our parents decided that they wanted a better life for their children that they would have. they could not leave her their, so she had to come here. it took her a while to learn english but by the time she graduated kindergarden she was perfect. from then on she was succesful in school. she was a great student. she graduated on the top 15% of her class. the thing is she wanted to go to college and study business administration. because she is an immigrant she could not get any scholarships or financial aid.
Folks,
I thought I'll share my FP experience in Oakland, CA which might be useful to others. I had my FP scheduled for tomorrow but since we have other errands to run tomorrow we went in today at 8:15 AM. To our surprise they did not even question us about the date. They just glanced at our FP notice and gave us a form to fill up. Even before I finished filling my form my number was up.
I just came back form my FP appt. I wanted to share my experience with you.
Hi there,
I had my N-400 interview in Portland, Oregon this afternoon. At the end, the officer printed the N-652 form and checked two boxes: a) you passed the tests of English and U.S. history and government; and b) Congratulations! Your application has been recommended for approval.
The interview was smooth and quick. I had 2 tickets for speeding, which I had included in my N-400 application. He said it was good I had included them because I got a citation (ticket), but that they're only interested in violations that involve arrests.
The process was very smooth and lasted for 3 full minutes. USCIS officer was professional and friendly and started the interview right on time. He asked me to take the oath first and then reviewed the application. Then he asked me to write a simple sentense, went through history & civics questions (all from the list of 100 USCIS has on its website) and once I answered first six correctly told me that I passed the exam and the application is approved. He said I will get oath notice in 1 - 2 months.

I'm on F-1 OPT with a STEM MS Degree. If I put a startup, I will be performing my roles directly related to the degree.
1) To establish employer-employee relations would having a board of directors be sufficient during STEM OPT?
2) If I apply for EB2-NIW and get I-140 approval then can I immediately shift to other non-tech roles within my startup (CTO -> CEO) Or do I have to wait for 6 months before doing that, all the while when I-485 is pending?
3) If I shift immediately and use I-485 EAD instead of F-1 EAD, then can that lead to I-485 being rejected?
Should I wait at least 6 months before using I-485 EAD? Also, if the startup fails, does that discontinue my I-485 process having approved I-140?
There are various visa options for entrepreneurs both inside and outside the USA, between non-immigrant and immigrant visas. Non-immigrant options include B-1 for temporary business visits, the International Entrepreneur Rule for temporary parole, and treaty visas like E-1 and E-2. Immigrant visa options include EB-1 for exceptionally qualified individuals, EB-2 National Interest Waiver (NIW) for those impacting US interests, and EB-5 for investors. Overall, EB-2 NIW offers flexibility in job changes within the same field and may lead to a green card without being tied to a specific job or employer.

I am currently on an H-1B visa. I am planning to start a business with my brother who is a US citizen and needs some guidance.
1) Until the business is operational and generating revenue, can I just be a partner in the company without doing any work visa application with it?
2) Can I have more than a 50% share in that company? If so, would that impact anyhow my H-1B with the current company?
3) In the future, if I want to file for concurrent or full-time H-1b through the new company, is it difficult to get it approved if my brother and I are the partners of the company?
4) Once I am on an H-1B visa in this new company, can the company file for my green card in the EB-1 or EB-2 category?
5) Does the company need to meet any specific conditions before sponsoring for H-1B and Employee-Based Green Card such as being E-Verified or having at least few citizens before hiring non-citizens?
Owning more than 50% of a company makes obtaining an H-1B visa difficult under current regulations. This is because the H-1B is for employees receiving a base salary, and owning a majority share raises doubts about a genuine employer-employee relationship. While regulations easing this restriction are pending, they haven't been finalized yet.
However, if you're a minority partner with your brother holding the majority and the job aligns with your field, securing an H-1B (concurrent or full-time) may be possible. Unfortunately, getting a green card through this company wouldn't be feasible due to your ownership. Consider exploring the EB-1A green card category, which recognizes individuals with exceptional ability in their field and doesn't require employer sponsorship.
