The travel bans necessitated by the COVID pandemic have created much flux and uncertainty. Synthesizing the information now finally available from various US government sources, it is clearer now that many intending travelers can seek and obtain an exemption from the ban under a series of provisions for a National Interest Exception (NIE).
You should be able to apply for an NIE to overcome the ban on travel to the USA if you meet any one or more of the following categories:
We are usually called upon by C and D visas holders for consultations. Click here to consult us.
The "C" visa is intended for those individuals whose travel takes them through the U.S., without intending to actually enter the U.S.

I can only recommend working with Rajiv's law offices. Rajiv himself and his teammates (Kalpana in our case) have been professional, efficient, smart and reliable.
We started to work with Rajiv to apply for a cap H1B in March 2016. Our file was excellent and we have been selected. Our petition, to our and Rajiv's immense surprise, has been denied without any relevant arguments from the immigration agent. Rajiv gave us precious advices, he was confident that we would win with an appeal. Rajiv built our appeal file, and later our RFE answer. We contacted Rajiv and Kalpana many times in the process; they always came back to us promptly and proposed call appointments in the next 2-4 business days. They were very well organized and precise in their answers. Our appeal has been sustained.
I was finally able to get the H1B visa. I know Rajiv and Kalpana are a big part of our success. I am very grateful for their work.
I am very greatfull to Rajiv Ji and his team for immediately responding to my request for help when I needed it in my immigration problems and queries, on calling Rajiv Ji's office the staff was very co-operative and scheduled a phone appointment with Rajiv Ji at the earliest since the time I had called and Rajiv Ji spoke to me the next day and answered all my queries without charging for it. which is the biggest help I could get. Words are not enough to Thank him for all the help he gives to people in need in his busy schedule at his position. Only Rajiv Ji can handle to help people and carry on his office with his profession in such a efficient way. He is the most kind and helping Immigration Attorney I know of in the USA. My prayers and best wishes go with him for God to shower his choicest blessings on him and his profession to flourish. THANK YOU RAJIV JI............:) YOU are like the light in the tunnel for Immigrants like me here in this foreign land.
They ran out of slots for the 10/30 oath about 7 people before me, so after that all of us got the N652 with "civics test/English passed" and "congratulations; it seems you are eligible...etc etc checked off, and when they handed it to to us they said our oath letters will be in the mail soon.

Form I-907, Request for Premium Processing Service

Question 1
1. Is it legal for an employee to pay all the expenses of a green card (eb2 / eb3), such as cost of attorney, pwd, recruitment, perm, I140 premium, I485, etc.?
2. Is it legal for employee to pay the cost of h1b premium transfer?
Question 2
My question is related to H1B stamping.
I have a stamped visa till April 2024 from my previous company.
I have a new I-797 from my current company.
Do I still have to go for Visa Stamping if I visit India in December 2023.
Answer 1: Employees cannot legally pay for green card expenses, H-1B fees, or premium processing associated with PERM. For the green card process, the employer must cover all costs. In the case of the I-140 stage, the employer should pay, especially if the employee is on H-1B. However, for the I-485 stage, the employee can pay.
Regarding H-1B, the employer should generally cover all expenses, except for premium processing. If premium processing is for the employee's benefit and the employer opts not to pay, the employee can choose to cover the cost. If premium processing is for the employer's convenience, the employer must pay.
In summary:
Green Card (PERM): Employer must pay; employee cannot.
I-140 stage: Employer should pay, especially for H-1B holders.
I-485 stage: Employee can pay.
H-1B expenses: Employer should pay, except for premium processing.
Premium processing: Employee can pay if for their benefit; otherwise, employer must pay.
Answer 2: Additionally, an employee with an old H-1B stamp from a previous employer can use it for a different employer. There's no need for new visa stamping if there's a new approval notice. Traveling on the old stamp with the new approval is permissible.

I really appreciate Mr. Rajiv, Kalpana, and their team for their work. They handled my case with utmost care and very professionally and did regular follow up with USCIS for the case status. They were always there to answer my questions and clarified them with almost details. I would highly recommend them if you have any immigration issues.
